This civil rights actn aris out of the nial by Universy of New Hampshire officials of the right of the Gay Stunts Organizatn (hereafter GSO), a homosexual anizatn, to hold "social functns. The Tste voted to get a nclive termatn of the "legaly and appropriatens of schlg social functns by the Gay Stunts Organizatn" and "directed that the terim the Universy admistratn would schle no further social functns by the Gay Stunts Organizatn until the matter is legally rolved. Although the play self ed ltle ment, there was some reactn to "Fag Rag Five" and "Fag Rag VI, " two "extremist homosexual" publitns which were distributed sometime durg the eveng.

Bonner, Print of the Universy, issued a public statement which nmned the distributn of the Fag Rag lerature, orred an "immediate vtigatn" to tablish rponsibily for the distributn, and clared: I am today servg notice on the Gay Stunts Organizatn that any repetn of the offendg behavr of December 7, 1973 will rult my seekg s immediate spensn as a stunt anizatn until the urts have acted on the several issu volvg *1093 GSO now before them. ), volved an attempt by universy officials to ny a gay stunt anizatn regnn and the right to hold a nference and dance. Homosexual sexual relatns, as fed by NH RSA 632:2, are illegal New Hampshire.

In fact, Kelly, an officer of the GSO, ttified that the GSO did not advote public homosexual acts. For the foregog reasons, the fendants are herewh enjoed om prohibg or rtrictg the sponsorship of social functns or e of Universy facili for such functns by the Gay Stunts Organizatn. Defendants are further enjoed om treatg the Gay Stunts Organizatn differently than other Universy stunt anizatns.
