argument of Obergefell v. Hodg, the same-sex marriage se, the Supreme Court on Tuday. Right after Mary Bonto, the lawyer challengg marriage bans several stat, pleted her argument, a spectator rose om a back row and started screamg, “If you support gay marriage, you will burn Hell!” As the man yelled, “It’s an abomatn!,” guards rried him om the urtroom.</p><p class="paywall">That wasn’t the ugly part, though. In the quiet moment after the man was removed, as his shouts vanished to the hallway, Jtice Anton Slia filled the silence wh a quip. “It was rather rehg, actually,” he said.</p><p class="paywall">It may have been jt a joke om the senr Associate Jtice on the Court, but what kd of joke—or was really a joke at all? Slia probably did thk that the directns of the protter was bracg—“rehg.” Ined, there’s every reason to believe that Slia more or ls shared the protter’s view of the immoraly of homosexualy, and that he regards the Court’s toleratn of gay people as one of the great disasters of his nearly three s as a Jtice.</p><p class="paywall">Slia’s unter-outburst was a notable ntrast to the rpectful tone of the rt of the argument, cludg om his fellow-nservativ. It is one measure of the succs of the gay-rights movement that all the other Jtic felt pelled to phrase their qutns ways that honored the humany of gay people. Jtice Anthony Kennedy gave voice to an issue of real ncern when he med, toward the begng of the argument, about jt how quickly the untry was changg, and about the part the Supreme Court should play. “One of the problems is, when you thk about the s and the word that keeps g back to me, this se, is ‘lennia.’ ” By that, Kennedy meant that the fn of marriage as the unn of one man and one woman has been around for thoands of years. “This fn has been wh for lennia. And ’s very difficult for the Court to say, ‘Oh, well, we know better.’ ”</p><div class="Contaer-bkChBi byNLHx"></div><p class="paywall">It should be difficult for unelected, unacuntable judg to remove a major issue like marriage om the will of the mocratilly elected branch of ernment. No judge should take such a step lightly. After Bonto said that gay people should be allowed to jo the stutn of marriage, Chief Jtice Roberts replied, “Well, you say ‘jo’ the stutn. The argument on the other si is that they’re seekg to refe the stutn. Every fn that I looked up, prr to about a dozen years ago, fed marriage as uny between a man and a woman, as hband and wife.
