argument of Obergefell v. Hodg, the same-sex marriage se, the Supreme Court on Tuday. Right after Mary Bonto, the lawyer challengg marriage bans several stat, pleted her argument, a spectator rose om a back row and started screamg, “If you support gay marriage, you will burn Hell!” As the man yelled, “It’s an abomatn!,” guards rried him om the urtroom.</p><p class="paywall">That wasn’t the ugly part, though. In the quiet moment after the man was removed, as his shouts vanished to the hallway, Jtice Anton Slia filled the silence wh a quip. “It was rather rehg, actually,” he said.</p><p class="paywall">It may have been jt a joke om the senr Associate Jtice on the Court, but what kd of joke—or was really a joke at all? Slia probably did thk that the directns of the protter was bracg—“rehg.” Ined, there’s every reason to believe that Slia more or ls shared the protter’s view of the immoraly of homosexualy, and that he regards the Court’s toleratn of gay people as one of the great disasters of his nearly three s as a Jtice.</p><p class="paywall">Slia’s unter-outburst was a notable ntrast to the rpectful tone of the rt of the argument, cludg om his fellow-nservativ. It is one measure of the succs of the gay-rights movement that all the other Jtic felt pelled to phrase their qutns ways that honored the humany of gay people. Jtice Anthony Kennedy gave voice to an issue of real ncern when he med, toward the begng of the argument, about jt how quickly the untry was changg, and about the part the Supreme Court should play. “One of the problems is, when you thk about the s and the word that keeps g back to me, this se, is ‘lennia.’ ” By that, Kennedy meant that the fn of marriage as the unn of one man and one woman has been around for thoands of years. “This fn has been wh for lennia. And ’s very difficult for the Court to say, ‘Oh, well, we know better.’ ”</p><div class="Contaer-bkChBi byNLHx"></div><p class="paywall">It should be difficult for unelected, unacuntable judg to remove a major issue like marriage om the will of the mocratilly elected branch of ernment. No judge should take such a step lightly. After Bonto said that gay people should be allowed to jo the stutn of marriage, Chief Jtice Roberts replied, “Well, you say ‘jo’ the stutn. The argument on the other si is that they’re seekg to refe the stutn. Every fn that I looked up, prr to about a dozen years ago, fed marriage as uny between a man and a woman, as hband and wife. Obvly, if you succeed, that re fn will no longer be operable.” Bonto, who gave a weak and haltg argument, failed fully to engage him.</p><div><div class="ConsumerMarketgUnThemedWrapper-iUTMTf jssHut nsumer-marketg-un nsumer-marketg-un--article-mid-ntent" role="prentatn" aria-hidn="te"><div class="nsumer-marketg-un__slot nsumer-marketg-un__slot--article-mid-ntent nsumer-marketg-un__slot---ntent"></div><div class="journey-un"></div></div></div><p class="paywall">In qutng Bonto, Slia further tablished his reputatn as the Fox News Jtice, who appears to e nservative talkg pots to prepare for oral arguments. Clearly drawg on a rervoir of outrage about the revisn of an Indiana law that would have effectively allowed bs to refe to do bs wh same-sex upl, Slia tried to pick an example that would motivate his iologil supporters, if not his lleagu. “Is nceivable that a mister who is thorized by the state to nduct marriage n cle to marry two men if, ed, this Court holds that they have a nstutnal right to marry?” he asked Bonto. “Is nceivable that that would be allowed?” Bonto and Jtice Elena Kagan shut down this silly ia wh dispatch. Unr the First Amendment’s ee-exercise-of-relign clse, ’s long been clear that misters n perform weddgs (or refe to perform them) for anyone they want.</p><p class="paywall">Fortunately for the platiffs, Solicor General Donald Verrilli, who was speakg for the Obama Admistratn, gave a superb argument support of marriage equaly the mere fifteen mut allotted to him. “The opportuny to marry is tegral to human digny,” he began. “Excludg gay and lbian upl om marriage means the digny of the upl. It did means their children, and ni the—both the upl and their children the stabilizg stcture that marriage affords.” (“Digny” is Kennedy’s favore word, and ’s funny to listen to lawyers panr to him by throwg at every opportuny.)</p><p class="paywall">Jtice Elena Kagan battered John Bursch, the lawyer for Michigan, wh var versns of the same qutn: What ernmental tert was the state servg by excludg gays om the stutn of marriage? Bursch’s answer: children. As Bursch put , “It has to do wh the societal unrstandg of what marriage means. This is a much bigger ia than any particular uple, and what a marriage might mean to them or to their children. And when you change the fn of marriage to lk the ia that we’re bdg children wh their blogil mom and dad, that has nsequenc.” Bursch uld never really say what those nsequenc were, nor uld he expla why heterosexual-only marriage had to be prerved for the sake of the children when lots of straight people don’t have kids and lots of gay and lbian people do.</p><p class="paywall">The most likely oute still looks like a victory for the plantiffs and marriage equaly all fifty stat. At a mimum, even before the cisn is announced, the argument self was an example of how much the untry, and the Court, has changed on the subject of gay rights.
