night before Thanksgivg, 2019, Lia García Peña, a profsor of Latx studi at Harvard, was her hoe Arlgton, Massachetts, seasong a large turkey. García Peña had reached that pot a scholar’s reer when great promise crystalliz to solid achievement. She had bee a leadg reference the field of ethnic studi; her first book, “<a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">The Borrs of Dominidad</a>,” had been well reviewed and had received several awards; a new book, on diasporic Blackns, was unr ntract wh the same publisher as her first, De Universy Prs.</p><p class="paywall">Hired 2013 as the only Black Lata on the tenure track at Harvard’s largt divisn, the Faculty of Arts and Scienc, García Peña had created a Latx-studi sendary field and area of foc, and llected numero awards for her teachg and petive fellowships. She was a beloved profsor; many of her stunts referred to her, affectnately, as La Profe. When another universy had tried to poach her earlier that year, her partment chair and two ans had enuraged her to apply for early tenure. The tenure mtee had unanimoly remend that she be promoted; a send, higher mtee had endorsed the remendatn.</p><p class="paywall">So, when Siskd notified her that Harvard had nied her tenure, she thought he was playg a prank—“<em>Me tás jodiendo</em>” (“You’re kiddg me”), she said, Spanish. (Siskd is Argentian.) But he was holdg back tears. For all practil matters, she was beg fired: faculty who have been nied tenure are required to leave Harvard.</p><p class="paywall">Tenure nials at Harvard are not unmon—the year that García Peña’s se was beg nsired, thirty-one per cent of the ndidat who went through the procs were nied tenure—but the news about García Peña sent rippl of outrage through the universy and beyond. More than five thoand stunts and scholars sent <a href=">an open letter</a> to Lawrence Baw, the universy print, mandg that he review her se. Close to a hundred Black scholars om universi across the untry penned <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">a siar letter</a>. Dozens of leadg ethnic-studi scholars gathered an eight-hour <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">symposium</a> at Harvard to discs the importance of her work. Stunts <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">rallied on the mp</a> for weeks.</p><p class="paywall">Harvard do not disclose the reasons for s tenure cisns, but a few faculty members had exprsed rervatns about García Peña’s work—most notably, that was activism rather than scholarship, a cricism that is often levelled agast scholars of ethnic studi. This is a first step that procs,” her lawyer, Ellen Zucker, told me. A spokperson for Harvard, Jonathan Swa, said that the universy “do not ment on dividual tenure s or report on tenure nials, as a matter of policy regardg personnel matters.”</p><p class="paywall">For supporters of ethnic studi at Harvard, García Peña’s tenure nial was the latt of several recent disappotments. Durg the past few years, the Harvard Ethnic Studi Coaln, a group of stunts and alumni, has nounced the parture of profsors Genevieve Clutar, who tght Asian Amerin history and accepted a posn at Wellley College; Natasha Warikoo, an expert on race and ethnic equaly who was nied tenure; and Ahmed Ragab, a Mlim profsor wh the Divy School who was also nied tenure. In their <a href=">view</a>, “Harvard has a history of treatg s radil and jtice-oriented scholars as dispensable,” recg ethnic-studi scholars, particular, and then clg to reta them. The aln plac much of the blame on Harvard’s tenure procs, which the judgment of the ndidate’s partment and the Faculty of Arts and Scienc n be overled whout explanatn by the print and the provost of the universy.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-1 viewport-monor-anchor"></div><p class="paywall">When I spoke to Siskd recently, he told me that he saw García Peña as sential to his partment. (His term as chair end last summer.) “Lia is such a charismatic person, such an excellent profsor and adviser, so mted to her stunts and her class, that she had bee dispensable,” he said. “My goal as partment chair was to make sure she stayed at the center of our efforts to satisfy the stunts’ growg mands for a proper ethnic-studi program and a Latx-studi program.” Siskd was stunned to learn that she would have to leave Harvard. “I had no doubts she was gog to get promoted and get tenure,” he said. “She certaly served .”</p><p class="has-dropp has-dropp__lead-standard-headg paywall">In recent s, Harvard, like many other universi, has rapidly diversified s stunt body. Today, fifty-four per cent of unrgraduat at Harvard self-intify as people of lor. Black stunts make up almost fifteen per cent of the llege populatn, and the number of Latx stunts has practilly doubled the past , om seven to almost thirteen per cent. As the llege populatn be creasgly nonwhe, there has been mountg prsure om stunts to have their muni reprented among their teachers. But the posn of the faculty has been much slower to change. Seventy-ne per cent of tenured faculty and sixty-four per cent of tenure-track faculty the F.A.S. are whe. Black and Latx faculty make up such a small percentage that they are grouped together as U.R.M., unrreprented mori, a bag that also holds Native Amerins. All the U.R.M. bed make up a mere ne per cent of tenured profsors.</p><p class="paywall">Stunts have sisted, too, on the importance of seeg their experienc acknowledged the curriculum. Ethnic studi, to many, is uniquely posned to meet those needs. The field evolved out of the civil-rights movement as an tellectual and polil project tent on lookg at the world om the pot of view of racially opprsed groups. As García Peña put a recent terview wh the <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank"><em>Boston Review</em></a>, “What we teach at every school right now—what we nsir to be the standard humani and social science curriculum—is actually ground whe supremacy, but is masked as objectivy. Ethnic studi is charged wh fillg the immense gap left by our Eurocentric tn systems.”</p><div><div class="ConsumerMarketgUnThemedWrapper-iUTMTf jssHut nsumer-marketg-un nsumer-marketg-un--article-mid-ntent" role="prentatn" aria-hidn="te"><div class="nsumer-marketg-un__slot nsumer-marketg-un__slot--article-mid-ntent nsumer-marketg-un__slot---ntent"></div><div class="journey-un"></div></div></div><p class="paywall">The field was not adopted gladly by the stutns that set out to transform. Many ethnic-studi partments and centers, cludg Ain Amerin studi, Latx studi, Asian Amerin studi, Native Amerin studi, and Arab Amerin studi, were tablished only after stunts mand them, and several s whstood police btaly and tear gas (at the Universy of California, Berkeley, 1969) or embarked on hunger strik (at Columbia Universy, 1996). As a rult of those battl, hundreds of ethnic-studi programs were eventually created universi across the untry. For their scholars, however, that was not nearly enough. Rob D. G. Kelley, a profsor of U.S. history at the Universy of California, Los Angel, and a major figure cultural studi, told me, “If you are gog to have ethnic studi, you have to be prepared to rethk the reproductn of knowledge, and who do , and how they do . If not, don’t bother.”</p><div class="Contaer-bkChBi byNLHx"></div><p class="paywall">Though Harvard’s fluential Department of Ain and Ain Amerin Studi recently celebrated s fiftieth anniversary, the universy never created a partment of ethnic studi. A senr faculty member who has been at Harvard for more than two s explaed that the reluctance to embrace ethnic studi stemmed om a number of objectns: “Some of is tellectual—people have disagreements about what form an ethnic-studi partment should take. Some of has to do wh people who are mted to their disciple and n be hostile to forms of study that are transdisciplary. And some of is polil. For some scholars, is a polil project—anti-racist, anti-imperialist—and they want that to be reflected the curriculum. Harvard is nservative many ways when to tradnal discipl and has a high regard for what they do.”</p><p class="paywall">Stunts have repeatedly asked for urs on Latx issu, and the creatn of a Latx-studi partment or a Latx cultural center. In 2002, Print Lawrence Summers <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">told them</a> that Harvard did not need Latx studi bee already had an “array of stutnal rourc,” cludg the David Rockefeller Center for Lat Amerin Studi—a statement not unlike sayg that a universy do not need Ain Amerin studi bee already has a partment dited to Ai. Mary Gaylord, a scholar of early-morn Spanish and Lat Amerin lerature, who has sce retired om teachg, told me, “We were all aware that this was a lacuna the curriculum we offered.”</p><p class="paywall">A search for a Latx-studi profsor was approved 2012: the new profsor would be appoted the Romance Languag and Lerature Department, and the History and Lerature program the History Department. Among the many ndidat’ applitns, the mtee found García Peña’s “extremely imprsive,” Kirsten Weld, a profsor of Lat Amerin history who was part of the mtee, said. At thirty-two, wh a master’s gree Spanish and Lat Amerin leratur and cultur, om Rutgers Universy, and a send master’s gree and a Ph.D. Amerin cultur, om the Universy of Michigan, García Peña had strong remendatn letters, a strong rearch profile, and a tenure-track posn as a Latx-studi profsor at the Universy of Geia.</p><p class="paywall">She was distguished, too, by her role the creatn of <a href=">Freedom Universy</a>. In October, 2010, jt a month to García Peña’s appotment at the Universy of Geia, the Geia Board of Regents barred undocumented stunts om attendg the state’s leadg public universi. “The muny I served was unr attack,” García Peña told me. Durg a meetg wh undocumented stunts who uld no longer e to class and a group of immigrant-rights activists, she asked how she uld help. “You are teachers,” a stunt replied. “Teach.” Freedom Universy held class on weekends, at an off-mp lotn. Volunteers drove the stunts to class the morng and back home at the end of the day. Her parents, who had been low-level ernment employe Santo Domgo, migrated to Trenton, New Jersey, the early neti, fleeg Print Joaquín Balaguer’s regime. She stayed behd wh an olr brother for thirteen months, until their parents, who found jobs as janors, uld afford to brg her to the Stat. García Peña was twelve years old when she arrived Trenton, and she beme one of a handful of Domin children at the lol public school. She was a gifted stunt and fished high school two months short of turng fifteen. Her parents felt that she was too young to be far om home, so she enrolled at Rutgers Universy.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-2 viewport-monor-anchor"></div><p class="paywall">García Peña started at Harvard the fall of 2013. A five-foot-eight-ch Black woman wh a mane of long, dark curls and an expansive personaly, she stood out om the start. Early her first semter, a guard at the entrance of the Barker Center for the Humani, where she had been given an office, tercepted her. “Exce me, do you need help?” he asked. She replied that she was faculty and kept walkg. The same guard stopped her aga another day to rm her, “This is not a public buildg.” García Peña asked some of her lleagu if they had ever been stopped by the guard; they had not. After siar teractns, she ma a formal plat to Siskd and did not see the guard aga.</p><p class="paywall">Tenure-track junr faculty are assigned a mentor to make them feel at home, help them navigate mp procr, and plan their reers. García Peña was lighted to get Doris Sommer, nsired one of the great Lat Amerin lerature scholars of her generatn. But, early on, Sommer warned García Peña that she would never be taken serly if she prented herself as a Latx-studi scholar; she remend that she troduce herself as a scholar of Lat Amerin lerature stead. In an e-mail, Sommer explaed that, addn to servg as García Peña’s mentor, she was part of the mtee that reced her, “precisely to velop Latx our Department of Romance Languag and Leratur.” When they spoke about García Peña’s work, Sommer wrote, “My advice—ank and supportive as wh all lleagu—was to feature lerature the project that she was proposg.” Sommer relled that, at one pot, García Peña had proposed “to study Domin women immigrants Italy. The project had very ltle to do wh lerary studi, as she acknowledged.”</p><p class="paywall">Sommer was also the chair of the mtee charge of asssg García Peña’s progrs her send year, the first of a seri of reviews on the road to tenure. After García Peña submted her portfol, Sommer summoned her to her office and remend that she whdraw the mancript of “The Borrs of Dominidad,” which García Peña had already submted to her edor, and that she change the directn of her rearch. The book exam Domin inty art, lerature, and film; García Peña wr, the troductn, “The methodology I follow throughout the book guis the rear to see how lerature and history have silenced black liv, actors, and histori om the archive of Dominidad, and <em>how</em> the silenc, turn, produced vlence and excln of actual human begs throughout the history of the natn.” In an e-mail, Sommer wrote, “I advised her, ankly, that there were areas of the book that uld be better veloped before publitn. This is standard advice om a lleague.” García Peña relled that Sommer warned, “It’s not gog to work out for you at Harvard.”</p><p class="paywall">A profsor who’s known Sommer for years told me that she might have thought she was offerg good advice—“I’ve been here for a long time; let me tell you what’s bt for you.” Acrdg to another profsor faiar wh the episo, was an example of a culture which senr faculty “have rather too much power”— which Sommer, rather than offerg guidance, stcted García Peña to rethk her reer. On the advice of a senr faculty member, García Peña reported the cint to the an, and Sommer was reprimand and rtricted om further teractns wh García Peña. Sommer wrote, “My approach has always been ank nversatn. The unhappy rult of preferrg ls ndor is the loss we all feel now.”</p><p class="paywall">García Peña’s first few years at Harvard were cloud by the teractns, but om the start her stunts adored her. “They flocked to her class,” Gaylord relled. For many, García Peña’s classroom offered a sense of refuge. The morng after <a href=">Donald Tmp</a> was elected, Keish Kim, a graduate stunt and a Korean immigrant, woke up feelg “immense pa and fear,” she told me. In class after class, she found that her profsors were teachg as if nothg had changed. Kim sought fort García Peña’s classroom, though she was not takg her class that semter. One of them threw the ntents of a cup of hot ffee over her cht. They ran away before she uld react. She reported the cint to the mp police, but the attackers were never found.</p><p class="paywall">Durg the followg weeks, García Peña bumped to small groups of her stunts wherever she went. She didn’t know , but they were worried about her and makg sure she got home safe at the end of the day. Alondra Ponce, who was then a llege stunt, explaed their ditn to García Peña: “She offers cril love and re and thoughtfulns. People feel weled her class bee no judgment is passed.” Ponce said that was only once she attend a Latx-studi class wh García Peña that she realized “what I wanted and who I was.” Massiel Torr, a graduate stunt, said that García Peña “ma a home for me a place that is so hospable.”</p><p class="paywall">García Peña’s most popular class, Performg Latidad, studied the social and polil nstcts behd the Latx inty by examg works of art. As part of the class, each stunt was required to give a performance on mp, pickg a spot ont of a buildg or next to a statue. The purpose of the exercise, García Peña told me, was for the stunts to create a “space for themselv” a Yard filled wh “statu of whe men.”</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-3 viewport-monor-anchor"></div><p class="paywall">In May, 2018, as the stunts were hangg a poster on a tree to announce their performanc, two mp guards stopped them, an enunter that the stunts scribed as “unfortable.” To prevent siar cints, the summer of 2019, García Peña went through a formal procs wh Yard Operatns, the office rponsible for thorizg mp events. She rmed them that, on October 24th, posters would be hung om tre and about seventy stunts would walk procsn through a sectn of the mp, stoppg ocsnally to read poetry, play the vl, and act out short scen; she exchanged e-mails wh Yard Operatns until all the tails were settled.</p><p class="paywall">That September, García Peña was the keynote speaker at the Latx Convotn, an event hosted by stunts to celebrate newly arrived Latx unrgraduat. She weled them to Harvard, but she warned, “There will be many days ahead of you when you won’t feel so weled. . . . And there will be many class which you will feel foreign, bee there is only one of you.” She told them that they would fd themselv cryg, “not havg the words to actually exprs what is that you are feelg.” On those days, she told them, remember that “you belong here.”</p><p class="paywall">Three days later, García Peña arrived at her office and found a note stuck to the door. A py had also been slipped unr the door, wh the same msage: “Go back to your untry you fuckg bch. You will never get tenure here. You belong the factory, you wetback, cunt.” The Harvard police never termed who had wrten the note. Print Baw and the F.A.S. an, Clde Gay, sent an e-mail to the mp muny nmng the “hateful act.” García Peña’s name was not mentned, but, bee of referenc to her genr, ethnicy, and immigratn stat, she was intifiable, and hate mail poured to her -box.</p><p class="paywall">On October 23rd, García Peña wrote to Yard Operatns to nfirm that her stunts’ performance would take place the next day, as planned. At 11:30 <em class="small">A.M.</em> on October 24th, three stunts were hangg posters on a nstctn fence near Houghton Library when a secury guard, summoned by a nstctn worker, approached them. The stunts relled that the guard told them, “You n’t prott here”; they explaed that they were workg on a class project. The guard lled Yard Operatns, and an officer there told him that he doubted that the stunts had approval. The guard then asked for I.D.s and took photos wh his cell phone. The stunts, who were undocumented, felt timidated. One of them ran to fetch García Peña while the guard had the others remove the posters. When García Peña arrived, another guard was there. She rmed them that the performance had been thorized, but the first guard replied, “You don’t have permissn. There’s no way you have permissn.” Eventually, the Yard Operatns official who had granted the permissn was reached and nfirmed that García Peña was tellg the tth. The performance ntued, but the stunts were so upset that García Peña held office hours until 9 <em class="small">P.M.</em> and throughout the followg day to lm them down.</p><p class="paywall">A group of profsors immediately nmned the “gratuo atmosphere of timidatn and mistst” agast García Peña and her stunts. This led to an ternal vtigatn missned by Gay, the F.A.S. an, which, on November 3rd, issued a report statg that had found no evince of “malic tent”—there was simply a munitn problem wh Yard Operatns. Still, the an’s office acknowledged that harm had been done. Sce the begng of the fall of 2019, she had been participatg a search mtee lookg to hire three or four scholars on Latx, Asian, and Mlim Amerin studi. A tenured profsor on the mtee relled that García Peña and others saw as a big step toward the creatn of an ethnic-studi partment, but after a few meetgs beme clear that the mtee was divid about . The Latx-studi posn, García Peña argued, should go to a scholar wh an ethnic-studi background. The chair of the mtee, Mary Waters, a soclogist wh a foc on migratn, favored ndidat who weren’t ethnic-studi scholars. One after another, the profsor relled, García Peña proposed ndidat, and Waters exprsed ncerns about them; discsns beme ntent. “The power dynamics the room need to be regnized,” the profsor told me. On one si, there was “a powerful tenured member of the universy wh a fancy endowed chair,” and, on the other, García Peña, “who was gog through the tenure procs at the time.” (Waters cled to ment for this story.)</p><p class="paywall">There is an unwrten le amia that says that, while you are up for tenure, you stay away om anythg remblg nflict. García Peña, to some lleagu’ shock and to others’ admiratn, did not abi by this law. “Lia always spoke her md and stood her ground, which, to be hont, was somethg that ma me worry about her,” a lleague who worked closely wh her said. “Many Harvard faculty nsir themselv to be good liberals, favor of social jtice, opposn to racism and equaly,” Weld poted out. “Lia is not part of that basele liberal nsens.” Her polics, Weld said, are more radil, and, when her stunts said, “This is not workg for ,” she stood by them. “And, jt by virtue of her existence and who she is, she was always vlatg this sort of unspoken norm on the mp. ‘You are not supposed to be polil before you have tenure.’ ‘You are not supposed to speak out agast the universy unls you are already unr s protectn.’ And she didn’t re about those norms bee she rrectly diagnosed a set of nsistenci between the stutn’s stated prcipl and the actual lived experience for people.”</p><p class="has-dropp has-dropp__lead-standard-headg paywall">In spe of García Peña’s ocsnal clash wh lleagu, she thought that her work was valued at Harvard. Her unrgraduate urs were packed, and 2019 she was advisg twenty-four doctoral ndidat. She had been given a named chair. More important to her, she had succsfully phed for the creatn of an ethnic-studi ncentratn the History and Lerature program, and a Latx-studi unrgraduate area of foc and graduate sendary field at F.A.S. After the cint wh Sommer, she had moved swiftly through the tenure procs, receivg glowg evaluatns on her send- and fourth-year reviews, after which she had been promoted om assistant profsor to associate profsor. She had fished her first book jt time for the send-year evaluatn, and her send book, a study of Black Latx diasporas on three ntents, was progrsg acrdg to the Harvard “clock” to be ready time for the seventh-year fal review. In early 2019, one semter away om her tenure applitn’s adle, García Peña told Siskd that she had received an offer for a tenured posn at another éle universy. He asked her to subm her tenure file ahead of time, by April 30th. She was reassured by all of her supervisors, she told me, that she “exceed the expectatns for tenure.”</p><p class="paywall">García Peña submted her dossier on April 15th. She had spent six and a half years preparg for this moment: this would be her fal review. Once a profsor obtas tenure, unls she ms a crime or another severe transgrsn, her posn is secure until retirement.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-4 viewport-monor-anchor"></div><p class="paywall">Many profsors who have succsfully gone through the tenure procs at Harvard scribe as a harrowg experience. Still, the current procre is nsired a great improvement: until 2005, there was no system place for junr faculty to apply for tenure at F.A.S., which was ually offered to outsi, wily regnized scholars wh long reers. Nowadays, the procs starts at the ndidate’s partment, where a group of tenured lleagu evaluate the applint’s dossier, which clus her résumé, published materials, stunt evaluatns, and teachg and rearch statements. The mtee then requts the wrten opns of about a dozen leadg scholars the ndidate’s field, acrdg to the F.A.S.’s Tenure-Track Handbook. Based on the dossier and the letters, mtee members vote on the ndidate’s promotn. García Peña received extremely posive letters om outsi scholars. Her se, an ement scholar the study of Amerin urban culture, Gee Lipsz, wrote his letter of remendatn, “is one of the most imprsive that I have seen my four s as an evaluator of personnel s.” On September 17th, the mtee voted unanimoly her favor.</p><p class="paywall">García Peña’s dossier and favorable report were sent to the Commtee on Appotments and Promotns at the Faculty of Arts and Scienc, a group of fourteen ans and profsors om a wi range of discipl. Confintial letters are requted at this pot om all senr faculty members the ndidate’s partment—everyone mt ope. This is a dread moment, a tenured profsor told me, bee anyone wh rervatns about your work n potentially end your reer at Harvard. In García Peña’s se, <em class="small">CAP</em> remend that she receive tenure. Rob Kelsey, the an of Arts and Humani, later said that the nsens on García Peña’s se was so strong that he “wouldn’t have been surprised if there hadn’t been an ad hoc”—a third mtee that is nvened some s—“and she’d jt been given tenure.” Instead, the print’s office cid to nvene an ad hoc. Judh Sger, the senr vice-provost for faculty velopment and diversy, ced “a handful of small ncerns,” acrdg to an ternal document, cludg the opn of at least one scholar that García Peña’s forthg book, “Translatg Blackns,” was “too narrow,” and a low rate of rponse to the requt for external letters of support. (A spokperson for Sger cled to ment for this story.)</p><p class="paywall">The ad-hoc mtee ually nsists of two or three tenured Harvard profsors not affiliated wh the partment that had ma the remendatn, pl two or three senr profsors om outsi the universy. Two ans and the print or provost are ex-offic members. The mtee reviews the se, hearg om “wns,” who ually clu a faculty member who has exprsed negative opns about the ndidate as well as members of the ndidate’s partment. No not are taken, and no vot are st. None of those participants have any real power over the fal cisn, which is ma by the print nsultatn wh the provost. This cisn is exprsed as a simple y or no.</p><p class="has-dropp has-dropp__lead-standard-headg paywall">After she hung up wh Siskd on the night before Thanksgivg, Garcia Peña felt numb. When the news sank , days later, she was vastated. “I am a strong person. I am not normally affected by setbacks. But I felt a great sense of loss,” she told me. “I had been nvced that when I reached tenure a new space for change would open for Latx studi and Domin studi. Any sacrifice was worth if change uld be real. In the end, I felt that all the effort had been for nothg.”</p><p class="paywall">In Febary, 2020, she filed a formal grievance agast Harvard. She had found out the name of a Harvard faculty member on the ad-hoc mtee, Jennifer Hochschild, and was shocked to learn about her volvement. Acrdg to other faculty members and an ternal document, Hochschild had repeatedly dismissed García Peña’s scholarship ont of other profsors, tegorizg her work as “not rearch, but activism.” (Hochschild cled to ment for this story.)</p><p class="paywall">In her grievance (which I obtaed through a third party), García Peña asked why “one of the very few faculty members who was particularly hostile and prejudiced to me as a person, to my field and to humanistic ethnic studi methodologi” was chosen to liberate on her future. The answer, she believed, uld be found lookg back over her years at Harvard—at her enunters wh mp secury, the note on her door, and the hate mail; her ll agast racism at Harvard durg the Latx nvotn; and the ntent search-mtee discsns. The cints, she alleged, had created a sense of unease wh the admistratn that was reflected the posn of her ad-hoc mtee. García Peña wrote that, “whether nscly or not,” there was “an impermissible bias agast my ndidacy as well as a disfort animated by my activi llg out racism and racist nduct on and around mp.”</p><p class="paywall">Grievanc are ually filtered by the F.A.S. docket mtee, a small group of profsors who al wh procral l. In García Peña’s se, the docket mtee remend a full vtigatn, and to that end a new panel, nsistg of three senr profsors om partments across F.A.S., was nvened. The grievance panel was given accs only to redacted sectns of García Peña’s tenure dossier and was not offered any explanatn for why she had been nied. They uld, and did, terview people volved the procs, except those the ad-hoc mtee, bee they were not allowed to know who they were.</p><p class="paywall">On Augt 21st, the panel submted s report. It was nfintial, and the panel members were sworn to secrecy. (I obtaed a py through a scholar outsi Harvard who did not take part the procs.) The report offered a harsh dictment of the universy’s treatment of García Peña, who, stated, had been the victim of a “pattern of beltlg, rcg, and ignorg.” In scribg this pattern, the report clud Sommer’s attempt to disurage García Peña’s rearch, and stanc which senr faculty dismissed ethnic studi as “provcial” and merely “inty polics.” The panel found “a preponrance of evince that the tenure review procs was marred by a pattern of discrimatn, which manifted as excsive, seemgly pretextual skepticism about her work, scholarly disciple, and reputatn.”</p><p class="paywall">The posn of the ad-hoc mtee was particularly troublg to the panel. “Profsor García Peña was hired to excel Ethnic Studi and was evaluated by an ad hoc mtee whose members clud those who have stated on multiple ocsns that Ethnic Studi . . . is so-lled advocy as opposed to scholarship,” they wrote. “Unr the circumstanc, regnizg excellence a field be impossible.” They named Hochschild, “who had exhibed public hostily towards the ndidate’s scholarship on multiple ocsns,” and argued that mtee members should have been vetted for bias agast the ndidate, jt as they were vetted for bias her favor. Instead of nveng a new mtee, they assigned a lawyer to nduct a new nfintial vtigatn. Acrdg to several faculty members I talked to, this was seen as a measure to protect the universy om a possible lawsu. On May 25th, a spokperson for F.A.S. nfirmed that García Peña’s last day at Harvard would be June 30th. By then, she had entered her claim wh the Massachetts Commissn Agast Discrimatn and had accepted a tenured posn the Department of Studi Race, Colonialism, and Diaspora at Tufts Universy, where she will start teachg the fall.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-5 viewport-monor-anchor"></div><p class="paywall">But the disappotment over her nial remaed. In the sprg of 2020, a <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">survey</a> nducted by the <em>Crimson</em> found that a majory of F.A.S. faculty rponnts favored the review of García Peña’s tenure procs, and more than a hundred F.A.S. profsors signed a letter mandg a “prehensive review” of the “entrenched and secretive” tenure system that tends to “favor tablished disciplary boundari over the emergg, terdisciplary fields bt suated to help unrstand our ntemporary world.” In rponse to this letter, Clde Gay, the an, lnched a review of the tenure procs, but soon she clarified that the role of the ad-hoc mtee would not be nsired.</p><p class="paywall">This March, the ntroversy over Harvard’s tenure procs epened. Cornel Wt, the public tellectual and a profsor of the practice of public philosophy at Harvard Divy School, announced that he too had been nied tenure, and left his post for a tenured posn at Unn Theologil Semary. He nounced a “pattern” of nyg tenure to scholars of lor, and clud García Peña on the list. Such ncerns, of urse, are voiced not only about Harvard. The more recent se of the journalist Nikole Hannah-Jon, who was <a href=">nied tenure</a> by the board of tste of the Universy of North Carola spe the unanimo support of the journalism partment and the universy learship, opened a natnal nversatn about bias agast scholars of race and racism amia. (The board reversed s cisn and granted her tenure on June 30th; Hannah-Jon then announced that she had accepted a tenured posn at Howard.)</p><p class="paywall">As part of the protts agast García Peña’s tenure nial, an unrgraduate stunt who had been ved, as a member of a mtee, to attend a regular faculty meetg stood the center of the room holdg a poster that lled on the universy to reverse s cisn. When Baw asked the stunt to eher put down the poster or move to a si of the room so as not to obstct the view, the stunt ignored him. Baw asked the faculty for a vote support of his requt, but many profsors voted agast him. The print appealed then to the docket mtee, the small group of profsors tasked, among other thgs, wh termg the orr of bs durg faculty meetgs. Kirsten Weld, the profsor of Lat Amerin history and a member of the mtee, proposed that the faculty discs the substance of the stunt’s mand stead. Baw said no.
