And the state may have to hold off on issug nearly half of the 150 dispensary licens signated for the first round.</p><p>That’s bee a feral judge issued an junctn last week that temporarily blocked New York om handg out retail licens certa parts of the state – cludg Brooklyn and the Mid-Hudson regn enpassg Wtchter and other unti jt north of New York Cy. Eleven other regns are not directly affected.</p><p>The temporary rtrag orr was requted by a pany lled Varisce NY One, which sued the state of New York and s Office of Cannabis Management late September. Varisce alleged that the state’s nnabis equy program vlat the “dormant merce clse” of the U.S. Constutn, which is meant to protect terstate merce, by discrimatg agast out-of-state applints. The state’s Condnal Adult-Use Retail Dispensary program, or CAURD, is prrizg people wh past dg nvictns and their fay members for the ial dispensary licens.</p><p>“This junctn will likely lay the issug of all 150 CAURD licens,” said <a href=" rel="noopener" target="_blank">Fatima Afia</a>, an attorney wh Hiller P.C., which has a nnabis law practice. “The qutn is, how much of a lay will there be? That's what we don't really know jt yet.”</p><p>The state is only planng to issue 150 dispensary licens the first round — and 63 were signated for areas impacted by the junctn. The number of licens alloted to each area is based on the number of people who live and mute there. Brooklyn was supposed to have 19 dispensari, the third most the state after Manhattan and Long Island. CAURD applints mt rank the top five parts of the state where they want to set up shop their applitns. But the pany failed to meet all the creria required by New York regulators.</p><p>The majory owner of the pany, Kenh Gay, was nvicted of a marijuana offense Michigan — not New York, which is a key requirement. And although the pany is <a href=" rel="noopener" target="_blank">registered</a> New York, the owners don’t live here. The CAURD program requir applints to have a “signifint prence” the state.</p><p>But ’s likely that Brooklyn and other impacted areas won’t go unserved by legal dispensari for long. He is currently volved a lawsu agast the cy of Sacramento, California, where he applied to sell marijuana through a different pany lled Peridot Tree, which he is the majory shareholr.</p><p>Gay sought a perm through Sacramento’s Cannabis Opportuny Revtment and Equy program, even though he didn’t meet the requirement to be a current or former rint of the cy.
