Whe victims acunt for only about half of all murr victims; yet 80% of all ath penalty s volve whe victims. 94.5% of elected prosecutors ath penalty stat are whe. A 2014 study found that Washgton jurors were nearly five tim more likely to impose the ath penalty on Black fendants than on siarly suated whe fendants. Instead, the state argued that sexual orientatn is a “choice” and that even direct evince of bias based on a fendant’s sexual orientatn do not warrant reversg a jury’s cisn to send a man to his ath. Natnwi, prosecutors often highlight a fendant’s LGBTQ+ inty, regardls of s relevance, as a way to humanize them and to portray them as sexually and morally viant.</p><div class="AdWrapper-dQtivb fZrssQ ad ad---ntent"><div class="ad__slot ad__slot---ntent" data-no-id="xc9gpc"></div></div><p>The Supreme Court has largely failed to addrs the dispari, makg virtually impossible to challenge racial or any other type of bias ath penalty s. Last year, however, a se lled Peña-Rodriguez v. Colorado, the Court reversed a jury verdict based on evince of racial bias the jury room. The attorneys reprentg Charl Rh hoped that the Court would extend s lg to bias based on sexual orientatn, argug that “like race-based bias, anti-gay bias systemic harm to the jtice system and, particular, pal jury sentencg.”</p><p>While the Court’s refal to do so is eply disappotg, the Supreme Court is often not the first urt to weigh on a new issue, before has been heard by urts across the untry, and the Supreme Court’s guidance is need to rolve disput between those urts. Moreover, while such a lg would send a crilly important msage that such overt exprsn of bias have no place our system of law, will no more elimate systemic bias agast LGBTQ+ fendants ath penalty s than will elimate such systemic bias based on race.</p><p>As the harsh reali show, the only sure way to elimate bias ath penalty s is to elimate the ath penalty self. Eighteen stat have already done so, and siar mpaigns are active most remag stat.
