In rponse to mountg cricism, Congrs enacted the Adoptn Assistance and Child Welfare Act 1980. The law provid feral funds to state agenci that were able to quickly fd permanent placements for foster children. The rult was a seri of legislative bans and executive orrs across the untry forbiddg the placements. At the time, many Amerins nsired LGBTQ rights a threat to their valu and opposed gay and lbian adoptn as harmful to children.</p></div><div class="article-body" data-qa="article-body"><p data-ttid="drop-p-letter" data-el="text" class="wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overriStyl font-py" dir="null">In 1985, after the Boston Globe reported that two young boys had been placed wh a gay uple, Massachetts Gov. Michael Dakis announced the state would give preference to “tradnal fay settgs.” Unr his new plan, sgle parents and unmarried upl uld foster children only if they received approval om the head of the child welfare agency. The policy did not explicly exclu gays or lbians, but officials the Dakis admistratn stated that such placements were “highly unlikely” given the burecratic hurdl the ernor had created. The state Hoe of Reprentativ quickly began batg a bill to bar “admted homosexuals” om adoptg a child or receivg foster re licens. The proposed law also prohibed licensg anyone whose hoehold members were gay.</p></div><div class="article-body" data-qa="article-body"><p data-ttid="drop-p-letter" data-el="text" class="wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overriStyl font-py" dir="null">Rep. Mildred Ingram, the bill’s sponsor, claimed baselsly that gay men molted children at higher rat than heterosexuals and argued that children would learn to be gay as a rult of havg gay and lbian role mols. The legislature enacted the prohibn, but civil servants ntued to approve gays and lbians as foster parents spe the statute. To skirt the law, they simply did not ask potential foster parents about their sexual orientatn. In 1987, Gloria Walker, the director of the Florida Department of Health and Rehabilative Servic’ adoptn service, admted that the agency had been ignorg the statute. Walker told reporters that “she knew ltle about the law or why passed the Florida Legislature” and that Florida’s adoptn forms did not ask applints about their sexual orientatn. “Don’t ask, don’t tell” had bee the operative prciple for the Sunshe State, too.</p></div><div class="article-body" data-qa="article-body"><p data-ttid="drop-p-letter" data-el="text" class="wpds-c-cYdRxM wpds-c-cYdRxM-iPJLV-css overriStyl font-py" dir="null">By 2015, when the Supreme Court led favor of marriage equaly <i>Obergefell v. Hodg</i>, ced the fact that LGBTQ upl around the untry were raisg “hundreds of thoands of children.” Some were blogil offsprg, but many were children that LGBTQ parents had weled to their hom as foster parents. Two of the platiffs the se, April DeBoer and Jayne Rowse, had adopted three children, one of whom was born prematurely and required around-the-clock re, and another who also had special needs.
