Wa may be the rare Supreme Court cisn that most Amerins n name, but ’s also one of the few that many volubly disparage—and not jt anti-abortn activists who want to get rid of altogether. Ruth Bar Gsburg was a stnch advote of accs to abortn but an open cric of the reasong behd Roe. She thought the ratnale should have centered on preventg sex discrimatn rather than on prervg a right to privacy. “The image you get om readg the Roe v. Wa opn is ’s mostly a doctor’s-rights se—a doctor’s right to prcribe what he thks his patient needs,” Gsburg told the legal wrer and scholar Jefey Rosen, 2019. “My ia of how choice should have veloped was not a privacy notn, not a doctor’s-right notn, but a woman’s right to ntrol her own sty, to be able to make choic whout a Big Brother state tellg her what she n and nnot do.”</p><p class="paywall">Gsburg also clared herself on board wh another crique of the cisn: namely, that when Roe was hand down, 1973, short-circued a polil procs whereby stat had been gradually legalizg abortn on their own, and th created the ndns for a polarizg backlash that we are still livg through. Although this terpretatn is not entirely borne out by the facts—more on that later— has ngealed to nventnal wisdom. “Jtice Harry Blackmun did more advertent damage to our mocracy than any other 20th-century Amerin,” the lumnist David Brooks wrote, 2005, of the opn’s thor. Roe v. Wa, Brooks argued, “set off a cycle of polil vicns and unter-vicns that has poisoned public life ever sce.” Unlike other lgs that regnized new social norms and tablished new nstutnal rights—to terracial marriage and same-sex marriage, for stance—Roe v. Wa remas vulnerable even now, nearly half a century later, to a precent-flippg, stare-cisis-floutg new lg. It has never been more so, fact, than is now. In the g term, the nservative-majory Court has agreed to hear a se which the state of Mississippi is sentially seekg to overturn Roe, along wh Planned Parenthood v. Casey (1992), which reaffirmed the right to abortn before the stage of fetal viabily. Earlier this month, the Court offered a preview of s orientatn when cled to halt enforcement of an even more dranian Texas law, which bans all abortns after about six weeks, a pot at which many women do not even know that they are pregnant.</p><div><div class="ConsumerMarketgUnThemedWrapper-iUTMTf jssHut nsumer-marketg-un nsumer-marketg-un--article-mid-ntent" role="prentatn" aria-hidn="te"><div class="nsumer-marketg-un__slot nsumer-marketg-un__slot--article-mid-ntent nsumer-marketg-un__slot---ntent"></div><div class="journey-un"></div></div></div><p class="paywall">Roe is unual another rpect. In most landmark s, the platiff don’t stick around like an ornery barfly at closg time, makg trouble for all sis. When Jane Roe, whose real name was Norma McCorvey, beme a platiff one of the hight-profile s ever to go before the Supreme Court, she was a broke, divorced, twenty-two-year-old Texan wh a nth-gra tn—“a street person, dg addict, dnk,” as she scribed herself, s later. Most of her lovers were women, but, 1970, she was untentnally pregnant for the third time, by a flaky married guy who was already out of the picture. She wasn’t lookg for a csa when she met wh the femist lawyers Sarah Weddgton and Lda Coffee at a pizza parlor Dallas; she was lookg for a way to end her pregnancy. Abortn was illegal Texas, and McCorvey was most likely too far along her pregnancy to make to one of the few stat where wasn’t; also, she’d been sred off by a rennaissance vis to an illegal practner closer to home.</p><p class="paywall">By the time the Court hand down s cisn the se, McCorvey had given birth to a baby girl and relquished her for adoptn. She had also met Connie Gonzalez, her voted partner for many years (although McCorvey cheated on her wh gto), and the two were ekg out a livg as hoecleaners. When McCorvey got the ll om Weddgton and learned that she’d prevailed the hight urt, the victory didn’t mean much to her. As the journalist Joshua Prager wr “The Fay Roe: An Amerin Story” (Norton), his prodigly rearched, richly tailed, sensively told acunt of McCorvey’s strange, and very Amerin, odyssey, “Her own lawyers had not much red to know her. She, turn, had not much red to know about their se; when, months later, Norma listed her red plastic datebook the important events of 1973, she clud the Yom Kippur War, the Texas State Fair, and the closg of a lol theater, but not the lawsu that bore her assumed name.”</p><p class="paywall">McCorvey eventually acknowledged that she was Jane Roe and, the late neteen-eighti and early neti, began makg appearanc the natnal media. She served as an ambivalent asset to the pro-choice movement, attendg ralli, and tellg her story—not pecially tthfully, acrdg to Prager— a bt-sellg 1994 memoir, “I Am Roe.” The ambivalence ran both ways, and was awkwardly riven by class. McCorvey thought the pro-choice lears were hoy-toy. They left her out of events memoratg Roe where she figured she should have been a featured speaker. She thought they wanted her to be somethg she wasn’t—“a mure . . . whe glove lady.” (She felt differently about the celebry lawyer Gloria Allred, who did the talk-show circu wh her for a while and brought out McCorvey’s salty, extemporaneo charm.)</p><p class="paywall">Pro-choice activists didn’t really want McCorvey donng whe glov, of all thgs, but they did tend to see her as a loose nnon and an unreliable narrator of her own life. For years, McCorvey had told reporters that the pregnancy she’d gone to urt over had been the rult of a rape. When she explaed, a 1987 terview, that was actually a nsensual enunter, the revelatn me as an embarrassment to the pro-choice movement. Anti-abortn activists seized on the admissn, argug that sentially validated the Court’s lg. Prager quot a letter to a Virgia newspaper om a preacher: “As a rult of McCorvey’s lie, more than twenty ln babi have been aborted.” In fact, neher McCorvey’s affidav nor Blackmun’s opn mentned anythg about <em>how</em> she got pregnant.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-1 viewport-monor-anchor"></div><p class="paywall">Then, the mid-neti, while McCorvey was answerg phon at an abortn clic, she met Flip Benham, a former saloonkeeper turned anti-abortn ant. Benham was a born-aga-Christian lay mister who preached not only agast abortn but also agast homosexualy. He kd of liked Norma, though, and, more to the pot, he saw her a prize nvert for his movement. Soon he was prsg a Bible to her hands, makg her a bs rd that read “Miss Norma, Slave for Christ,” and baptizg her a back-yard pool suburban Dallas. So began McCorvey’s turn as an asset to the <em>other</em> si the abortn wars. The head of Texans Uned for Life crowed, “The poster child has jumped off the poster.” In time, McCorvey rebelled agast Benham’s sistence that she renounce her lbianism, but she ntued to st her lot wh the anti-abortn si, eventually nvertg to Catholicism.</p><p class="paywall">Prager is not unsympathetic to McCorvey, but he se her clearly. He not that, unlike some of her femist alli, pro-life lears, even though they rejected her homosexualy, “ma a public pot of embracg Norma as she was—blunt and blue-llar.” He pats a believable portra of a woman who red about flirtg and fun, sctn and sex, attentn and affirmatn—“watchg out for Norma’s salvatn and Norma’s ass,” as she once put —but not about iology, or polics, or anybody else’s rights, really, let alone their souls. McCorvey nfid to Prager, who spent time wh her at the end of her life, “It’s really a lot harr on this si bee you gotta act like you re. Yet, Prager’s persuasive tellg, was not so much a secret al as a product of McCorvey’s personaly. It’s te that the documentary McCorvey, terviewed a nursg home, tells the filmmaker, Nick Sweeney, “If a young woman wants to have an abortn, fe, ’s no sk off my ass.” And when Sweeney asks if her advocy for the pro-life si “was all an act,” she repli, “Yeah. I did well, too.” Though the film suggts that anti-abortn activists had paid McCorvey handsomely, Prager says she ma somethg like eight hundred dollars on average for a talk, and “stggled to hold on to what ltle she earned.” In fact, the pro-choice si had paid her for public appearanc, too, but she never got rich off eher movement. You don’t get the imprsn that McCorvey was purposefully lyg to activists on eher si. When she cid that people were beg high and mighty wh her, was enough to send her skterg back and forth across what seemed to others like profound dividg l of nscience and belief. She jt don’t seem to have red all that much about reproductive rights. McCorvey, speakg of her fectn to the anti-abortn mp, told Prager, “I was lonely for some excement. I need to do somethg that would e media attentn. Isn’t that awful?”</p><p class="paywall">Prager got an astonishg array of people to talk to him for this book—om short-term girliends of McCorvey’s to the son of Henry Wa, the Dallas D.A. who was Roe’s legal antagonist and who, we learn here, was secretly pro-choice. The book is most pellg, though, when ’s relatg the personal saga of a woman and her fay ught the gears of history. Prager brgs two characters beyond McCorvey’s orb—Mildred Jefferson, an Ain Amerin pro-life lear, and Curtis Boyd, a doctor who provid abortns before and after Roe—but their stori don’t add much to the narrative. Its drive om Prager’s efforts to track down the three dghters whom McCorvey gave up for adoptn.</p><div class="Contaer-bkChBi byNLHx"></div><p class="paywall">What he learns about the women don’t here to a neat takeaway, although ’s notable that all three tell him they are pro-choice. The olst, who was partly raised by Norma’s mother and sister, and who knew Norma, yearns for a ep fay bond wh her two half sisters and hop that they’ll fd a way to accept their mother. The middle sister, who most rembl McCorvey and is, like her, a lbian, is more terted rmatn about her blogil parents than a relatnship wh them. The youngt, the so-lled Roe baby, was intified by a pro-life private tective shortly before her neteenth birthday, layg the groundwork for a <em>Natnal Enquirer</em> story. Until then, she had pretend that her real parents were Ann-Margret and Elvis Prley, and she tells Prager that she wish she’d never learned the facts of her birth. The sisters’ liv are ordary, zigzaggg between rough passag (prsn, divorce, domtic abe, addictn) and perds of fulfillment (gog back to school, lovg a job at a florist’s, meetg a nice new guy or gal, embracg stay-at-home motherhood). And yet, bee their blogil mother happens to have been Jane Roe, they are also extraordary. It’s like a fairy tale set workg-class Ameri, each sister rryg a secret and a curse.</p><p class="has-dropp has-dropp__lead-standard-headg paywall">Would a different Jane Roe have changed the way the se has been perceived over the years? Readg “The Fay Roe,” you wonr whether someone other than McCorvey might have been a better f for the role, and whether she might have been served better by sisteppg . The one thg McCorvey had wanted when she went to see the lawyers she’d been referred to was an abortn—and she never got . Weddgton and Coffee do seem to have told her that, by the time her se ma to urt, would almost certaly be too late to end the pregnancy. But they did not help her to get an abortn, and, as Prager not, they uld at least have tried. Weddgton had worked wh a service that referred people seekg abortns to clics California (where was legal) and Mexi (where was quasi-legal). The prevailg atmosphere was so sexist that the Texas assistant attorney general prefaced his argument wh a lame quip about the difficulty of facg off agast “such betiful ladi.” There is much to admire about her: she went on to w a seat the state legislature, to wre a memoir about the se, and to bee a popular speaker on llege mp. But Prager says that early terviews Weddgton ma sound as if McCorvey had cid to rry her pregnancy to term to make sure she would still have standg, thereby savg the se. In fact, Prager wr, “Norma had shown no such valor.” Coffee gets a more sympathetic treatment, perhaps part bee Weddgton cled to talk to Prager, and part bee Coffee had a much lower profile for s. By the time Prager loted her, she had been acquted of d charg (after allegedly fg a client’s signature) and spend by the Texas bar a few tim, when she got behd on her licensg payments. She was livg quietly wh her partner a small town East Texas, where was not easy to be open about her gay inty. Her fanc were prer enough that she relied on a lol food bank. When she was ved, wh Weddgton, to a pro-choice fund-raisg event 2019, the former partners history-makg hadn’t seen each other twenty-seven years.</p><p class="paywall">By the time the pro-life movement took McCorvey aboard, anti-abortn activists had wined their foc om the vulnerable fet to the woman rryg —who, they argued, would be morally, emotnally, and physilly damaged by an abortn. The purported damage ranged om regret to a nstellatn of wo lled “post-abortn syndrome.” Ronald Reagan’s Surgeon General C. Everett Koop was tasked wh llectg evince of P.A.S., but admted that he uldn’t fd any. Evince of route regret was also lackg. A large-sle study nducted by rearchers at the Universy of California, San Francis, found that, five years out, the vast majory of women who had unrgone an abortn said had been the right choice for them. In any se, regret is a dub basis for policy. People regret all kds of cisns, large and small, but we don’t proactively prive them of their cisn-makg agency on the chance that they might. The anti-abortn movement ma McCorvey to a sad-eyed embodiment of tormentg send thoughts. Here, after all, was the very woman whose pregnancy had legalized abortn, now cryg . As a young ligator wh the A.C.L.U., Ruth Bar Gsburg had hoped that the Court’s first abortn se would be one which she was reprentg a woman seekg <em>not</em> to have an abortn. The woman was San Stck, a nurse the Air Force who beme pregnant 1970, while servg Vietnam. The ary gave her two choic: have an abortn or be immediately discharged. (Though illegal most stat, abortn was allowed on ary bas.) The Supreme Court agreed to hear Stck v. Secretary of Defense, but the meantime the Air Force, realizg that would likely lose, overturned the policy. An opn the Stck se, Gsburg believed, would have anchored the right to have an abortn—like the right not to have one— the notn of equaly. A whole class of people uld not be nied equal treatment unr the law simply bee they were subject to the ndn of pregnancy.</p><p class="paywall">“The Fay Roe” tells that Weddgton and Coffee, hedgg their bets agast the possibily that Norma would drop out of the su, had challenged the Texas abortn law on behalf of another platiff as well. Her name was Marsha Kg, and she was, Prager wr, “unlike Norma almost every way.” A married engeer wh an advanced gree physics, Kg had talked openly about the importance of abortn rights ever sce havg a gellg procre herself, Mexi. She was ill health and didn’t want to risk gettg pregnant aga, but, bee she wasn’t currently pregnant, the Texas urt that heard the se found she didn’t have standg. Even so, there might have been many other ndidat like Kg. By 1970, there had been speak-outs where women me forward public foms to talk about their own fears of unwanted pregnancy and their experienc wh illegal abortnists. The were femists attuned to the wir signifince of legalizg abortn, more mted to a e than to their own immediate self-tert.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-2 viewport-monor-anchor"></div><p class="paywall">In the years sce Roe, some civil-rights lawyers seem to have sought out appealg, well-spoken clients, wh a history of activism or at least veloped opns on the issue at stake. That was te, for stance, of most of the platiffs the lawsus seekg to legalize same-sex marriage, who were upstandg embodiments of rpectabily polics—monogamo, middle class, sometim votedly rg for a disabled partner. Projectg a sort of “disda for polics” was often part of the package, as Cynthia Godsoe, a profsor at Brooklyn Law School, pots out an say lled “Perfect Platiffs.” Jim Obergefell, the platiff Obergefell v. Hodg (2015), the se that tablished same-sex marriage, told reporters, “No one uld ever acce of beg activists. . . . We jt lived our liv.” Still, Godsoe wr, “several had been volved prev LGB advocy; all were attractive ndidat for reful recment by e lawyers.” A belief the missn and the support of other people who believe n gird a person for a long, public fight, makg thgs easier on the client, emotnally, and on the larger movement, polilly.</p><p class="paywall">And yet a platiff’s character or mment don’t necsarily matter to the oute of the se. It was easy to love the Lovgs, the platiffs Lovg v. Virgia (1967), which legalized terracial marriage across the untry. Their lawyers uld accurately prent them as ordary, apolil ral folks, a uple who loved each other and simply wanted to live together quietly and legally. Yet, as Godsoe not, the dream clients wh the dream name me to their lawyers by “happenstance.” John Lawrence, of Lawrence v. Texas (2003), the landmark Supreme Court se that overturned sodomy laws, was nobody’s ia of a dream platiff. He had displayed no tert gay-rights activism, and he had a prev nvictn for vehicular homici. One night, the police vad his home whout a warrant and arrted him for havg sex wh another man. Lawrence’s partner wasn’t even his lover, as the law profsor Dale Carpenter revealed his book on the se, “Flagrant Conduct.” But arrts for sodomy Texas were rare, so this one offered a valuable opportuny to challenge a set of assumptns behd legal anti-gay discrimatn. Wa, wonrg how uld have been different. Maybe, as Jtice Gsburg believed, would have been better to ground the right to abortn equaly rather than privacy. You n see the pfalls of a “my body, my choice” absolutism—or a riture of — the anti-vacce and anti-mask movements of today. Many femist thkers now argue for a more clive, and potentially sturdier, fense of abortn rights what’s often lled reproductive jtice. It embrac the eedom to have children, wh aquate social supports to raise them, as well as the eedom to postpone or prevent childbearg. That would mean, as Reva Siegel, a law profsor at Yale, has put , lookg beyond abortn and askg, “What are all the ways that law impg on—empowers or disempowers—people their timate and their fay liv?”</p><p class="paywall">On the other hand, Jtice Blackmun’s elaboratn of a nstutnal right to privacy, the assertn that there are areas of timate life on which the state nnot encroach, has been important subsequent cisns erng the right to marry whom one choos, and the unrstandg of human rights more generally. And the backlash argument—that was the judicial overreach of Roe that created this untry’s long-lastg divisn over abortn—serv at least an asterisk. There’s no doubt that Roe exerted what Prager scrib as a galvanizg effect on anti-abortn activists. It has been a mastay of evangelil polics for s, and all the more offensive to some bee uld be attributed to what Anton Slia lled “the black-robed supremacy” on the feral bench. Yet Siegel and Lda Greenhoe, a former Supreme Court reporter for the <em>Tim</em>, have dug to the backlash claim and provid a set of plitg facts. Pollg on the eve of Roe showed that a “substantial majory” of Amerins favored crimalizg abortn, cludg two-thirds of self-intified Republins and fifty-six per cent of Catholics. But, they wre, “spe broad popular support, liberalizatn of abortn law had all but e to a halt the face of ncerted opposn by a Catholic-led mory.” Republins began stokg opposn to abortn as part of a strategy to lure workg-class Catholic voters and Southerners who were alienated by the Democratic Party’s outreach to mori, by the unterculture, and by the women’s movement. In Greenhoe and Siegel’s view, there is nothg uniquely backlash-ducg about a judicial, as opposed to a legislative, extensn of rights.</p><p class="paywall">As for McCorvey herself, precisely bee of her ambivalence she was, signifint ways, a highly reprentative and therefore advertently eloquent platiff. As Prager wr, “If Norma was unfortable wh the creasg surety and absolutism of both movements, she was hardly alone.” By the end of her life, she occupied what she lled “the mhy middle,” supportg, as many Amerins do, abortn rights but wh some lims. And the fact that she did not want to be a parent was certaly related to what Gsburg lled “the right to ntrol her own sty.” Her topsy-turvy life is a remr, too, that if the personal is the polil, the polil is also the personal, driven by nsistency and exigency.</p><p class="paywall">McCorvey wanted an abortn at a time when some women uld fly to California or Oregon or Mexi to get one and others uld not. She simply didn’t have the money. Today, more than half of those who have abortns live below the feral poverty le. And they are the on who will suffer if the Supreme Court overturns Roe. Women will always seek to end unwanted pregnanci, as they have throughout history, and throughout the world, regardls of what the law says. Ined, dog so is easier now than ever, given the availabily of reliable abortn-ducg dgs that n be taken at home and are creasgly provid by onle servic. People of means seekg abortns will be able to travel to stat that have strengthened their own laws to make sure the procre n still be offered there. Women short on funds, or rmatn, or child re, or the abily to take time off om work will be out of luck and, if they do fd a way to end an unwanted pregnancy, more vulnerable to prosecutn. Norma McCorvey’s obuary the Washgton <em>Post</em> end, aptly, wh somethg she said 1994: “I don’t require that much my life. I jt never had the privilege to go to an abortn clic, lay down, and have an abortn. Wa may be the rare Supreme Court cisn that most Amerins n name, but ’s also one of the few that many volubly disparage—and not jt anti-abortn activists who want to get rid of altogether. Ruth Bar Gsburg was a stnch advote of accs to abortn but an open cric of the reasong behd Roe. She thought the ratnale should have centered on preventg sex discrimatn rather than on prervg a right to privacy. “The image you get om readg the Roe v. Wa opn is ’s mostly a doctor’s-rights se—a doctor’s right to prcribe what he thks his patient needs,” Gsburg told the legal wrer and scholar Jefey Rosen, 2019. “My ia of how choice should have veloped was not a privacy notn, not a doctor’s-right notn, but a woman’s right to ntrol her own sty, to be able to make choic whout a Big Brother state tellg her what she n and nnot do.”</p><p class="paywall">Gsburg also clared herself on board wh another crique of the cisn: namely, that when Roe was hand down, 1973, short-circued a polil procs whereby stat had been gradually legalizg abortn on their own, and th created the ndns for a polarizg backlash that we are still livg through. Although this terpretatn is not entirely borne out by the facts—more on that later— has ngealed to nventnal wisdom. “Jtice Harry Blackmun did more advertent damage to our mocracy than any other 20th-century Amerin,” the lumnist David Brooks wrote, 2005, of the opn’s thor. Roe v. Wa, Brooks argued, “set off a cycle of polil vicns and unter-vicns that has poisoned public life ever sce.” Unlike other lgs that regnized new social norms and tablished new nstutnal rights—to terracial marriage and same-sex marriage, for stance—Roe v. Wa remas vulnerable even now, nearly half a century later, to a precent-flippg, stare-cisis-floutg new lg. It has never been more so, fact, than is now. In the g term, the nservative-majory Court has agreed to hear a se which the state of Mississippi is sentially seekg to overturn Roe, along wh Planned Parenthood v. Casey (1992), which reaffirmed the right to abortn before the stage of fetal viabily. Earlier this month, the Court offered a preview of s orientatn when cled to halt enforcement of an even more dranian Texas law, which bans all abortns after about six weeks, a pot at which many women do not even know that they are pregnant.</p><div><div class="ConsumerMarketgUnThemedWrapper-iUTMTf jssHut nsumer-marketg-un nsumer-marketg-un--article-mid-ntent" role="prentatn" aria-hidn="te"><div class="nsumer-marketg-un__slot nsumer-marketg-un__slot--article-mid-ntent nsumer-marketg-un__slot---ntent"></div><div class="journey-un"></div></div></div><p class="paywall">Roe is unual another rpect. In most landmark s, the platiff don’t stick around like an ornery barfly at closg time, makg trouble for all sis. When Jane Roe, whose real name was Norma McCorvey, beme a platiff one of the hight-profile s ever to go before the Supreme Court, she was a broke, divorced, twenty-two-year-old Texan wh a nth-gra tn—“a street person, dg addict, dnk,” as she scribed herself, s later. Most of her lovers were women, but, 1970, she was untentnally pregnant for the third time, by a flaky married guy who was already out of the picture. She wasn’t lookg for a csa when she met wh the femist lawyers Sarah Weddgton and Lda Coffee at a pizza parlor Dallas; she was lookg for a way to end her pregnancy. Abortn was illegal Texas, and McCorvey was most likely too far along her pregnancy to make to one of the few stat where wasn’t; also, she’d been sred off by a rennaissance vis to an illegal practner closer to home.</p><p class="paywall">By the time the Court hand down s cisn the se, McCorvey had given birth to a baby girl and relquished her for adoptn. She had also met Connie Gonzalez, her voted partner for many years (although McCorvey cheated on her wh gto), and the two were ekg out a livg as hoecleaners. When McCorvey got the ll om Weddgton and learned that she’d prevailed the hight urt, the victory didn’t mean much to her. As the journalist Joshua Prager wr “The Fay Roe: An Amerin Story” (Norton), his prodigly rearched, richly tailed, sensively told acunt of McCorvey’s strange, and very Amerin, odyssey, “Her own lawyers had not much red to know her. She, turn, had not much red to know about their se; when, months later, Norma listed her red plastic datebook the important events of 1973, she clud the Yom Kippur War, the Texas State Fair, and the closg of a lol theater, but not the lawsu that bore her assumed name.”</p><p class="paywall">McCorvey eventually acknowledged that she was Jane Roe and, the late neteen-eighti and early neti, began makg appearanc the natnal media. She served as an ambivalent asset to the pro-choice movement, attendg ralli, and tellg her story—not pecially tthfully, acrdg to Prager— a bt-sellg 1994 memoir, “I Am Roe.” The ambivalence ran both ways, and was awkwardly riven by class. McCorvey thought the pro-choice lears were hoy-toy. They left her out of events memoratg Roe where she figured she should have been a featured speaker. She thought they wanted her to be somethg she wasn’t—“a mure . . . whe glove lady.” (She felt differently about the celebry lawyer Gloria Allred, who did the talk-show circu wh her for a while and brought out McCorvey’s salty, extemporaneo charm.)</p><p class="paywall">Pro-choice activists didn’t really want McCorvey donng whe glov, of all thgs, but they did tend to see her as a loose nnon and an unreliable narrator of her own life. For years, McCorvey had told reporters that the pregnancy she’d gone to urt over had been the rult of a rape. When she explaed, a 1987 terview, that was actually a nsensual enunter, the revelatn me as an embarrassment to the pro-choice movement. Anti-abortn activists seized on the admissn, argug that sentially validated the Court’s lg. Prager quot a letter to a Virgia newspaper om a preacher: “As a rult of McCorvey’s lie, more than twenty ln babi have been aborted.” In fact, neher McCorvey’s affidav nor Blackmun’s opn mentned anythg about <em>how</em> she got pregnant.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-1 viewport-monor-anchor"></div><p class="paywall">Then, the mid-neti, while McCorvey was answerg phon at an abortn clic, she met Flip Benham, a former saloonkeeper turned anti-abortn ant. Benham was a born-aga-Christian lay mister who preached not only agast abortn but also agast homosexualy. He kd of liked Norma, though, and, more to the pot, he saw her a prize nvert for his movement. Soon he was prsg a Bible to her hands, makg her a bs rd that read “Miss Norma, Slave for Christ,” and baptizg her a back-yard pool suburban Dallas. So began McCorvey’s turn as an asset to the <em>other</em> si the abortn wars. The head of Texans Uned for Life crowed, “The poster child has jumped off the poster.” In time, McCorvey rebelled agast Benham’s sistence that she renounce her lbianism, but she ntued to st her lot wh the anti-abortn si, eventually nvertg to Catholicism.</p><p class="paywall">Prager is not unsympathetic to McCorvey, but he se her clearly. He not that, unlike some of her femist alli, pro-life lears, even though they rejected her homosexualy, “ma a public pot of embracg Norma as she was—blunt and blue-llar.” He pats a believable portra of a woman who red about flirtg and fun, sctn and sex, attentn and affirmatn—“watchg out for Norma’s salvatn and Norma’s ass,” as she once put —but not about iology, or polics, or anybody else’s rights, really, let alone their souls. McCorvey nfid to Prager, who spent time wh her at the end of her life, “It’s really a lot harr on this si bee you gotta act like you re. Yet, Prager’s persuasive tellg, was not so much a secret al as a product of McCorvey’s personaly. It’s te that the documentary McCorvey, terviewed a nursg home, tells the filmmaker, Nick Sweeney, “If a young woman wants to have an abortn, fe, ’s no sk off my ass.” And when Sweeney asks if her advocy for the pro-life si “was all an act,” she repli, “Yeah. I did well, too.” Though the film suggts that anti-abortn activists had paid McCorvey handsomely, Prager says she ma somethg like eight hundred dollars on average for a talk, and “stggled to hold on to what ltle she earned.” In fact, the pro-choice si had paid her for public appearanc, too, but she never got rich off eher movement. You don’t get the imprsn that McCorvey was purposefully lyg to activists on eher si. When she cid that people were beg high and mighty wh her, was enough to send her skterg back and forth across what seemed to others like profound dividg l of nscience and belief. She jt don’t seem to have red all that much about reproductive rights. McCorvey, speakg of her fectn to the anti-abortn mp, told Prager, “I was lonely for some excement. I need to do somethg that would e media attentn. Isn’t that awful?”</p><p class="paywall">Prager got an astonishg array of people to talk to him for this book—om short-term girliends of McCorvey’s to the son of Henry Wa, the Dallas D.A. who was Roe’s legal antagonist and who, we learn here, was secretly pro-choice. The book is most pellg, though, when ’s relatg the personal saga of a woman and her fay ught the gears of history. Prager brgs two characters beyond McCorvey’s orb—Mildred Jefferson, an Ain Amerin pro-life lear, and Curtis Boyd, a doctor who provid abortns before and after Roe—but their stori don’t add much to the narrative. Its drive om Prager’s efforts to track down the three dghters whom McCorvey gave up for adoptn.</p><div class="Contaer-bkChBi byNLHx"></div><p class="paywall">What he learns about the women don’t here to a neat takeaway, although ’s notable that all three tell him they are pro-choice. The olst, who was partly raised by Norma’s mother and sister, and who knew Norma, yearns for a ep fay bond wh her two half sisters and hop that they’ll fd a way to accept their mother. The middle sister, who most rembl McCorvey and is, like her, a lbian, is more terted rmatn about her blogil parents than a relatnship wh them. The youngt, the so-lled Roe baby, was intified by a pro-life private tective shortly before her neteenth birthday, layg the groundwork for a <em>Natnal Enquirer</em> story. Until then, she had pretend that her real parents were Ann-Margret and Elvis Prley, and she tells Prager that she wish she’d never learned the facts of her birth. The sisters’ liv are ordary, zigzaggg between rough passag (prsn, divorce, domtic abe, addictn) and perds of fulfillment (gog back to school, lovg a job at a florist’s, meetg a nice new guy or gal, embracg stay-at-home motherhood). And yet, bee their blogil mother happens to have been Jane Roe, they are also extraordary. It’s like a fairy tale set workg-class Ameri, each sister rryg a secret and a curse.</p><p class="has-dropp has-dropp__lead-standard-headg paywall">Would a different Jane Roe have changed the way the se has been perceived over the years? Readg “The Fay Roe,” you wonr whether someone other than McCorvey might have been a better f for the role, and whether she might have been served better by sisteppg . The one thg McCorvey had wanted when she went to see the lawyers she’d been referred to was an abortn—and she never got . Weddgton and Coffee do seem to have told her that, by the time her se ma to urt, would almost certaly be too late to end the pregnancy. But they did not help her to get an abortn, and, as Prager not, they uld at least have tried. Weddgton had worked wh a service that referred people seekg abortns to clics California (where was legal) and Mexi (where was quasi-legal). She herself had obtaed an abortn Mexi a few years earlier.</p><figure class="AssetEmbedWrapper-eVDQiB byBkf asset-embed"><div class="AssetEmbedAssetContaer-eJxoAx dBHGoQ The prevailg atmosphere was so sexist that the Texas assistant attorney general prefaced his argument wh a lame quip about the difficulty of facg off agast “such betiful ladi.” There is much to admire about her: she went on to w a seat the state legislature, to wre a memoir about the se, and to bee a popular speaker on llege mp. But Prager says that early terviews Weddgton ma sound as if McCorvey had cid to rry her pregnancy to term to make sure she would still have standg, thereby savg the se. In fact, Prager wr, “Norma had shown no such valor.” Coffee gets a more sympathetic treatment, perhaps part bee Weddgton cled to talk to Prager, and part bee Coffee had a much lower profile for s. By the time Prager loted her, she had been acquted of d charg (after allegedly fg a client’s signature) and spend by the Texas bar a few tim, when she got behd on her licensg payments. She was livg quietly wh her partner a small town East Texas, where was not easy to be open about her gay inty. Her fanc were prer enough that she relied on a lol food bank. When she was ved, wh Weddgton, to a pro-choice fund-raisg event 2019, the former partners history-makg hadn’t seen each other twenty-seven years.</p><p class="paywall">By the time the pro-life movement took McCorvey aboard, anti-abortn activists had wined their foc om the vulnerable fet to the woman rryg —who, they argued, would be morally, emotnally, and physilly damaged by an abortn. The purported damage ranged om regret to a nstellatn of wo lled “post-abortn syndrome.” Ronald Reagan’s Surgeon General C. Everett Koop was tasked wh llectg evince of P.A.S., but admted that he uldn’t fd any. Evince of route regret was also lackg. A large-sle study nducted by rearchers at the Universy of California, San Francis, found that, five years out, the vast majory of women who had unrgone an abortn said had been the right choice for them. In any se, regret is a dub basis for policy. People regret all kds of cisns, large and small, but we don’t proactively prive them of their cisn-makg agency on the chance that they might. The anti-abortn movement ma McCorvey to a sad-eyed embodiment of tormentg send thoughts. Here, after all, was the very woman whose pregnancy had legalized abortn, now cryg . But the regret McCorvey exprsed time and aga was about <em>not</em> gettg an abortn—she even shared that sentiment wh a reporter sent to ver her born-aga baptism.</p><p class="has-dropp has-dropp__lead-standard-headg paywall">There had been other possible platiffs, other possible rout to the Supreme Court. As a young ligator wh the A.C.L.U., Ruth Bar Gsburg had hoped that the Court’s first abortn se would be one which she was reprentg a woman seekg <em>not</em> to have an abortn. The woman was San Stck, a nurse the Air Force who beme pregnant 1970, while servg Vietnam. The ary gave her two choic: have an abortn or be immediately discharged. (Though illegal most stat, abortn was allowed on ary bas.) The Supreme Court agreed to hear Stck v. Secretary of Defense, but the meantime the Air Force, realizg that would likely lose, overturned the policy. An opn the Stck se, Gsburg believed, would have anchored the right to have an abortn—like the right not to have one— the notn of equaly. A whole class of people uld not be nied equal treatment unr the law simply bee they were subject to the ndn of pregnancy.</p><p class="paywall">“The Fay Roe” tells that Weddgton and Coffee, hedgg their bets agast the possibily that Norma would drop out of the su, had challenged the Texas abortn law on behalf of another platiff as well. Her name was Marsha Kg, and she was, Prager wr, “unlike Norma almost every way.” A married engeer wh an advanced gree physics, Kg had talked openly about the importance of abortn rights ever sce havg a gellg procre herself, Mexi. She was ill health and didn’t want to risk gettg pregnant aga, but, bee she wasn’t currently pregnant, the Texas urt that heard the se found she didn’t have standg. Even so, there might have been many other ndidat like Kg. By 1970, there had been speak-outs where women me forward public foms to talk about their own fears of unwanted pregnancy and their experienc wh illegal abortnists. The were femists attuned to the wir signifince of legalizg abortn, more mted to a e than to their own immediate self-tert.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-2 viewport-monor-anchor"></div><p class="paywall">In the years sce Roe, some civil-rights lawyers seem to have sought out appealg, well-spoken clients, wh a history of activism or at least veloped opns on the issue at stake. That was te, for stance, of most of the platiffs the lawsus seekg to legalize same-sex marriage, who were upstandg embodiments of rpectabily polics—monogamo, middle class, sometim votedly rg for a disabled partner. Projectg a sort of “disda for polics” was often part of the package, as Cynthia Godsoe, a profsor at Brooklyn Law School, pots out an say lled “Perfect Platiffs.” Jim Obergefell, the platiff Obergefell v. Hodg (2015), the se that tablished same-sex marriage, told reporters, “No one uld ever acce of beg activists. . . . We jt lived our liv.” Still, Godsoe wr, “several had been volved prev LGB advocy; all were attractive ndidat for reful recment by e lawyers.” A belief the missn and the support of other people who believe n gird a person for a long, public fight, makg thgs easier on the client, emotnally, and on the larger movement, polilly.</p><p class="paywall">And yet a platiff’s character or mment don’t necsarily matter to the oute of the se. It was easy to love the Lovgs, the platiffs Lovg v. Virgia (1967), which legalized terracial marriage across the untry. Their lawyers uld accurately prent them as ordary, apolil ral folks, a uple who loved each other and simply wanted to live together quietly and legally. Yet, as Godsoe not, the dream clients wh the dream name me to their lawyers by “happenstance.” John Lawrence, of Lawrence v. Texas (2003), the landmark Supreme Court se that overturned sodomy laws, was nobody’s ia of a dream platiff. He had displayed no tert gay-rights activism, and he had a prev nvictn for vehicular homici. One night, the police vad his home whout a warrant and arrted him for havg sex wh another man. Lawrence’s partner wasn’t even his lover, as the law profsor Dale Carpenter revealed his book on the se, “Flagrant Conduct.” But arrts for sodomy Texas were rare, so this one offered a valuable opportuny to challenge a set of assumptns behd legal anti-gay discrimatn. Wa, wonrg how uld have been different. Maybe, as Jtice Gsburg believed, would have been better to ground the right to abortn equaly rather than privacy. You n see the pfalls of a “my body, my choice” absolutism—or a riture of — the anti-vacce and anti-mask movements of today. Many femist thkers now argue for a more clive, and potentially sturdier, fense of abortn rights what’s often lled reproductive jtice. It embrac the eedom to have children, wh aquate social supports to raise them, as well as the eedom to postpone or prevent childbearg. That would mean, as Reva Siegel, a law profsor at Yale, has put , lookg beyond abortn and askg, “What are all the ways that law impg on—empowers or disempowers—people their timate and their fay liv?”</p><p class="paywall">On the other hand, Jtice Blackmun’s elaboratn of a nstutnal right to privacy, the assertn that there are areas of timate life on which the state nnot encroach, has been important subsequent cisns erng the right to marry whom one choos, and the unrstandg of human rights more generally. And the backlash argument—that was the judicial overreach of Roe that created this untry’s long-lastg divisn over abortn—serv at least an asterisk. There’s no doubt that Roe exerted what Prager scrib as a galvanizg effect on anti-abortn activists. It has been a mastay of evangelil polics for s, and all the more offensive to some bee uld be attributed to what Anton Slia lled “the black-robed supremacy” on the feral bench. Yet Siegel and Lda Greenhoe, a former Supreme Court reporter for the <em>Tim</em>, have dug to the backlash claim and provid a set of plitg facts. Pollg on the eve of Roe showed that a “substantial majory” of Amerins favored crimalizg abortn, cludg two-thirds of self-intified Republins and fifty-six per cent of Catholics. But, they wre, “spe broad popular support, liberalizatn of abortn law had all but e to a halt the face of ncerted opposn by a Catholic-led mory.” Republins began stokg opposn to abortn as part of a strategy to lure workg-class Catholic voters and Southerners who were alienated by the Democratic Party’s outreach to mori, by the unterculture, and by the women’s movement. In Greenhoe and Siegel’s view, there is nothg uniquely backlash-ducg about a judicial, as opposed to a legislative, extensn of rights.</p><p class="paywall">As for McCorvey herself, precisely bee of her ambivalence she was, signifint ways, a highly reprentative and therefore advertently eloquent platiff. As Prager wr, “If Norma was unfortable wh the creasg surety and absolutism of both movements, she was hardly alone.” By the end of her life, she occupied what she lled “the mhy middle,” supportg, as many Amerins do, abortn rights but wh some lims. And the fact that she did not want to be a parent was certaly related to what Gsburg lled “the right to ntrol her own sty.” Her topsy-turvy life is a remr, too, that if the personal is the polil, the polil is also the personal, driven by nsistency and exigency.</p><p class="paywall">McCorvey wanted an abortn at a time when some women uld fly to California or Oregon or Mexi to get one and others uld not. She simply didn’t have the money. Today, more than half of those who have abortns live below the feral poverty le. And they are the on who will suffer if the Supreme Court overturns Roe. Women will always seek to end unwanted pregnanci, as they have throughout history, and throughout the world, regardls of what the law says. Ined, dog so is easier now than ever, given the availabily of reliable abortn-ducg dgs that n be taken at home and are creasgly provid by onle servic. People of means seekg abortns will be able to travel to stat that have strengthened their own laws to make sure the procre n still be offered there. Women short on funds, or rmatn, or child re, or the abily to take time off om work will be out of luck and, if they do fd a way to end an unwanted pregnancy, more vulnerable to prosecutn. Norma McCorvey’s obuary the Washgton <em>Post</em> end, aptly, wh somethg she said 1994: “I don’t require that much my life. I jt never had the privilege to go to an abortn clic, lay down, and have an abortn.
