ANY AND ALL SUCH FOOTAGE AND MATERIALS SHALL BE EMED "WORKS MA FOR HIRE" SPECIALLY ORRED AS PART OF A MOTN PICTURE OR OTHER D-VISUAL WORK, AND I WAIVE THE EXERCISE OF ANY “MORAL RIGHTS,” “DRO MORAL,” AND ANY ANALOGO RIGHTS, HOWEVER NOMATED, ANY JURISDICTN OF THE WORLD. TO THE EXTENT I RETA ANY TERT THE FOOTAGE AND MATERIALS, I HEREBY GRANT AND ASSIGN TO PRODUCER ALL RIGHTS OF ANY NATURE AND TO ALL SUCH FOOTAGE AND MATERIALS. WHOUT ANY WAY LIMG THE FOREGOG, I WILL NOT STALK, ABE, HARASS, THREATEN, TIMIDATE, ASSLT, RAPE, JURE OR DAMAGE ANY PERSON OR PROPERTY AND SHALL REA OM E OF VLENCE AND OTHER APPROPRIATE BEHAVR AT ALL TIM.  I HEREBY AGREE THAT, THE EVENT OF A BREACH OF THREATENED BREACH OF MY OBLIGATNS UNR THIS SECTN, PRODUCER WILL BE ENTLED, ADDN TO ANY OTHER REMEDI AVAILABLE TO AT LAW OR EQUY, TO (I) LIQUIDATED DAMAG THE AMOUNT OF FIVE HUNDRED THOAND DOLLARS ($500,000) AND (II) JUNCTIVE RELIEF, WHOUT ANY REQUIREMENT TO MONSTRATE IRREPARABLE HARM OR POST A BOND. I UNRSTAND THAT MAY BE A FERAL OFFENSE, UNLS DISCLOSED TO PRODUCER PRR TO THE EXHIBN OF THE PROGRAM, IF ANY, TO DO ANY OF THE FOLLOWG: (A) GIVE OR AGREE TO GIVE ANY MEMBER OF THE PRODUCTN STAFF AND ANYONE ASSOCIATED ANY MANNER WH THE PROGRAM OR ANY REPRENTATIVE OF PRODUCER ANY PORTN OF MY PENSATN OR ANYTHG ELSE OF VALUE TO ARRANGE MY APPEARANCE THE PROGRAM OR THE ADVERTISEMENTS; OR (B) ACCEPT OR AGREE TO ACCEPT ANYTHG OF VALUE TO PROMOTE ANY PRODUCT, SERVICE OR VENTURE ON THE AIR OR TO E ANY PREPARED MATERIAL NTAG SUCH A PROMOTN.  I REPRENT AND WARRANT THAT I GAVE NOTHG OF VALUE NOR DID I AGREE TO GIVE ANYTHG OF VALUE TO ANYONE SO I ULD BE THE PROGRAM OR THE ADVERTISEMENTS.  I KNOW THAT PRODUCER DO NOT PERM AND THAT MAY BE A FERAL OFFENSE NOT TO TELL PRODUCER IF I HAD.  I SHALL NOTIFY PRODUCER AND ANY WORK ON WHICH THE PROGRAM WILL AIR IMMEDIATELY IF ANY PERSON ATTEMPTS OR HAS ATTEMPTED TO DUCE ME TO DO ANYTHG VLATN OF THE FOREGOG OR WHICH IS ANY WAY DISHONT.6. I UNRSTAND THAT I WILL NOT BE PAID FOR PARTICIPATG THE ACTIVY, FOR APPEARG THE PROGRAM, THE ADVERTISEMENTS, AND THE FOOTAGE AND MATERIALS OR ANY NEWS VERAGE OF THE SAME, FOR GIVG PRODUCER THE RIGHTS LISTED THIS AGREEMENT, OR FOR PRODUCER’S EXERCISE OF ANY AND ALL OF THE RIGHTS LISTED THIS AGREEMENT. I HEREBY WAIVE ANY AND ALL RIGHTS I MAY HAVE TO ANY PENSATN WHATSOEVER. I ACKNOWLEDGE AND AGREE THAT A SIGNIFINT ELEMENT OF THE NSIRATN I AM RECEIVG UNR THIS AGREEMENT IS THE OPPORTUNY FOR PUBLICY THAT I WILL RECEIVE IF PRODUCER CLUS THE FOOTAGE AND MATERIALS THE PROGRAM OR THE ADVERTISEMENTS. I KNOW PRODUCER WILL CUR SIGNIFINT STS AND EXPENS RELIANCE UPON THIS AGREEMENT, SO I WILL NOT ATTEMPT TO NCEL OR TO REVOKE ANY OF THE RIGHTS GRANTED TO PRODUCER HERE. I ACKNOWLEDGE THAT I AM A VOLUNTEER AND THAT I SHALL NOT BE EMED TO BE AN EMPLOYEE OF PRODUCER, NOR SHALL I BE ENTLED TO THE BENEFS PROVID BY PRODUCER TO S EMPLOYE. TO THE EXTENT THAT I RECEIVE ANYTHG OF VALUE NNECTN WH THE PROGRAM, CLUDG BUT NOT LIMED TO GOODS AND SERVIC, I SHALL BE RPONSIBLE FOR ALL TAX AND OTHER OBLIGATNS THAT ARE OR MAY BEE DUE OM ME.7. I UNRSTAND THAT AND NNECTN WH THE PROGRAM, I MAY REVEAL OR RELATE, AND OTHER PARTI (CLUDG, WHOUT LIMATN, OTHER PARTICIPANTS, NEWS SOURC, PRODUCER, THE HOST OF THE PROGRAM (IF ANY), AND NETWORK) MAY REVEAL OR RELATE RMATN ABOUT ME OF A PERSONAL, PRIVATE, SURPRISG, FAMATORY, DISPARAGG, EMBARRASSG OR UNFAVORABLE NATURE, AND THAT MY ACTNS AND THE ACTNS OF OTHERS PARTICIPATG THE PROGRAM MAY BE EMBARRASSG OR OF AN OTHERWISE UNFAVORABLE NATURE THAT MAY BE FACTUAL OR FICTNAL. I FURTHER UNRSTAND THAT MY APPEARANCE, PICTN, AND PORTRAYAL AND NNECTN WH THE PROGRAM OR OTHERWISE, AND MY ACTNS AND THE ACTNS OF OTHERS DISPLAYED AND NNECTN WH THE PROGRAM OR OTHERWISE, MAY BE DISPARAGG, FAMATORY, EMBARRASSG OR OF AN OTHERWISE UNFAVORABLE NATURE, MAY EXPOSE ME TO PUBLIC RIDICULE, HUIATN OR NMNATN, AND MAY PORTRAY ME A FALSE LIGHT. I ACKNOWLEDGE AND AGREE THAT NEWS SOURC, PRODUCER, NETWORK, AND ANY ENTY THAT SPONSORS, ADVERTIS , EXHIBS OR OTHERWISE EXPLOS THE FOOTAGE AND MATERIALS, THE PROGRAM OR ANY OTHER PRODUCTN, AND ANY OF THEIR LICENSE, SUCCSORS AND ASSIGNS, SHALL HAVE THE RIGHT (BUT NOT THE OBLIGATN): (A) TO CLU ANY SUCH RMATN AND ANY SUCH APPEARANCE, PICTN, PORTRAYAL, ACTNS AND STATEMENTS THE PROGRAM OR ANY OTHER EXHIBN OR EXPLOATN OF THE FOOTAGE AND MATERIALS, AND ANY AND ALL ADVERTISEMENTS; AND (B) TO EXHIB, BROADST AND OTHERWISE EXPLO THE FOOTAGE AND MATERIALS, THE PROGRAM, AND THE ADVERTISEMENTS NTAG ANY SUCH RMATN AND ANY SUCH APPEARANCE, PICTN, PORTRAYAL OR ACTNS. CONFINTIAL INFORMATN CLUS, BUT IS NOT LIMED TO, ANY RMATN OR MATERIALS I LEARN OR ACQUIRE NCERNG OR RELATG TO PRODUCER OR ANY TELEVISN WORKS OR DISTRIBUTORS OF THE PROGRAM (“NETWORK”), THE BS OF PRODUCER OR NETWORK, THE TERMS AND NDNS OF THIS AGREEMENT, ANY PROGRAM PRODUCED BY PRODUCER OR EXHIBED BY NETWORK, CLUDG, WHOUT LIMATN, ANY RMATN NCERNG OR RELATG TO THE PROGRAM, THE PROGRAM PARTICIPANTS, THE VENU OR LOTN(S) OF THE PROGRAM, THE EVENTS NTAED THE PROGRAM OR THE OUTE OF ANY EVENT THE PROGRAM. I ACKNOWLEDGE AND AGREE THAT THE CONFINTIAL INFORMATN IS NFINTIAL AND THE EXCLIVE PROPERTY OF PRODUCER OR NETWORK. AT NO TIME WILL I EVER, DIRECTLY OR DIRECTLY, DIVULGE ANY MANNER, OR E OR PERM OTHERS TO E, ANY OF THE CONFINTIAL INFORMATN. MY OBLIGATNS WH RPECT TO NFINTIALY AS SET FORTH THIS PARAGRAPH SHALL NTUE PERPETUY OR UNTIL TERMATED BY NETWORK WRG. IN NO EVENT SHALL I HAVE THE RIGHT TO TERMATE MY NFINTIALY OBLIGATNS UNR THIS AGREEMENT. (B) I ACKNOWLEDGE THAT ANY BREACH BY ME OF ANY OF THE NFINTIALY PROVISNS OF THIS AGREEMENT WOULD E PRODUCER AND NETWORK IRREPARABLE JURY AND DAMAGE THAT NNOT BE REASONABLY OR AQUATELY PENSATED BY DAMAG AN ACTN AT LAW.  I HEREBY EXPRSLY AGREE THAT PRODUCER AND NETWORK SHALL BE ENTLED TO JUNCTIVE AND OTHER EQUABLE RELIEF (WHOUT POSTG ANY BOND) TO PREVENT OR CURE ANY BREACH OR THREATENED BREACH OF THE NFINTIALY PROVISNS OF THIS AGREEMENT BY ME. I WILL FEND, MNIFY AND HOLD HARMLS PRODUCER, NETWORK, THEIR PARENT, SUBSIDIARY AND AFFILIATED PANI, AND EACH OF THEIR RPECTIVE OFFICERS, DIRECTORS, AGENTS, REPRENTATIV AND EMPLOYE, OM AND AGAST ANY AND ALL CLAIMS, ACTNS, DAMAG, LIABILI, LOSS, STS AND EXPENS (CLUDG, WHOUT LIMATN, ATTORNEYS’ FE) THAT ANY WAY ARISE OUT OF OR RULT OM MY BREACH OF ANY OF THE NFINTIALY PROVISNS OF THIS AGREEMENT.(C) WHOUT ANY WAY LIMG THE FOREGOG, I FURTHER AGREE THAT WHOUT THE PRR APPROVAL OF PRODUCER AND/OR NETWORK EACH STANCE, I SHALL NOT DISCS THE PROGRAM OR MY PARTICIPATN THE PROGRAM WH ANY THIRD PARTY, EXCEPT THAT I MAY MAKE CINTAL, NON-ROGATORY MENTN THAT I PARTICIPATED THE PROGRAM (I.E., “I PARTICIPATED UPDATG”) ONLY AFTER THE EARLIER OF WHEN I APPEAR OR THE PUBLIC ANNOUNCEMENT BY PRODUCER OR NETWORK OF MY PARTICIPATN THE PROGRAM.110. I AGREE NOT TO MAKE ANY MERCIAL OR ANY OTHER E OF THE FACT THAT I APPEARED THE PROGRAM OR THAT PRODUCER ED THE FOOTAGE AND MATERIALS THE PROGRAM. NEHER I NOR ANYONE ACTG ON MY BEHALF SHALL AT ANY TIME E ANY OF PRODUCER’S OR NETWORK’S NAM, LOGOS, TRA NAM OR TRAMARKS (CLUDG, BUT NOT LIMED TO, THE TLE OF THE PROGRAM), OR THOSE OF ANY OF PRODUCER’S OR NETWORK’S RELATED PANI, FOR ANY PURPOSE OR ANY MANNER WHATSOEVER.11. IN THE EVENT OF A BREACH OR FLT OF THIS RELEASE BY PRODUCER, I AGREE THAT MY SOLE REMEDY SHALL BE THE RIGHT TO SEEK MONEY DAMAG CURRED AS A RULT OF SUCH BREACH OR FLT, IF ANY. I SHALL NOT SEEK OR HAVE THE RIGHT TO JUNCTIVE OR OTHER EQUABLE RELIEF, OR TO RCD THIS RELEASE, OR THE RIGHTS GRANTED HERE, OR TO RTRA ANY MANNER THE PRODUCTN, DISTRIBUTN, EXHIBN, ADVERTISG OR ANY OTHER EXPLOATN OF THE PROGRAM OR ANY PRODUCTN BASED UPON THE RIGHTS GRANTED HERNR OR PRODUCED PURSUANT TO THIS RELEASE, OR ANY SUBSIDIARY OR ANCILLARY RIGHTS NNECTN WH THE FOREGOG. IN NO EVENT SHALL PRODUCER BE LIABLE FOR NSEQUENTIAL, EXEMPLARY OR PUNIVE DAMAG, OR LOST OR ANTICIPATED PROFS.12.
