Jackson Women’s Health Organizatn, brought by the State of Mississippi. It was the first se that the Court had taken thirty years which the petners were explicly askg the Jtic to overturn <a href=">Roe v. Wa</a>, the 1973 cisn legalizg abortn, and s succsor, Planned Parenthood v. Casey, which affirmed that cisn 1992. If anyone need a remr that, whatever the Jtic ci Dobbs, will not rencile the Amerin divi over abortn, the chaotic scene outsi the Court ma clear. At the base of the marble steps, reproductive-rights supporters held a large rally which they characterized abortn as a human right—and an act of health re. <a href=">Praa Jayapal</a>, a Democratic U.S. reprentative om Washgton State, scribed herself as “one of the one four women Ameri who have had an abortn,” addg, “Termatg my pregnancy was not an easy choice, but was <em>my</em> choice.” Jayapal uld barely be heard, though, over the anti-abortn protters who had also gathered, even greater numbers. The day was sunny and d, and though some of the monstrators offered the ual angry admonishments—“God is gog to punish you, murrer!” a man wh a megaphone claimed—most members of the anti-abortn ntgent seemed buoyant. Bloads of stunts om Liberty Universy, an evangelil llege Lynchburg, Virgia, snapped selfi their matchg red-whe-and-blue jackets. Penny Nance, the head of the nservative group Concerned Women for Ameri, exclaimed, “This is our moment! <em>This</em> is why we’ve marched all the years!”</p><p class="paywall">A major reason for Nance’s optimism was the prence on the bench of Amy Coney Barrett, the former Notre Dame law profsor and feral-urt judge whom Print <a href=">Donald Tmp</a> had picked to replace <a href=">Ruth Bar Gsburg</a>, who died on September 18, 2020. Wh the help of <a href=">Mch McConnell</a>, the Senate Majory Lear, Tmp had accelerated Barrett’s nomatn procs, and the Senate nfirmed her jt a week before the 2020 Printial electn. As a ndidate the 2016 electn, Tmp had vowed to appot Jtic who would overturn Roe, and as Print he had ma a prry to stock the judiciary wh nservative judg—pecially younger on. Acrdg to an analysis by the law profsors David Fontana, of the Gee Washgton Universy, and Mih Schwartzman, of the Universy of Virgia, Tmp’s nome to the feral urts of appeals—bodi that, like the Supreme Court, nfer lifetime tenure—were the youngt of any Print’s “sce at least the begng of the 20th century.” Tmp ma three Supreme Court appotments, and <a href=">Neil Gorsuch</a> (forty-ne when nfirmed) and <a href=">Brett Kavangh</a> (fifty-three) were the youngt of the ne Jtic until Barrett was sworn , at the age of forty-eight. Her arrival gave the nservative wg of the Court a 6–3 supermajory—an imbalance that won’t be altered by the recent news that one of the three liberal Jtic, <a href=">Stephen Breyer</a>, is retirg.</p><p class="paywall">Barrett has a hard-to-rattle temperament. A fns enthiast seemgly blsed wh superhuman energy, she is rearg seven children wh her hband, Jse Barrett, a former prosecutor now private practice. At her nfirmatn heargs, she drsed wh self-assurance—a fted magenta drs; a ladylike skirted su unexpected shas of purple—and projected an air of ro, almost serene diligence. Dpe her pro-forma circumspectn, her answers on issu om guns to climate change left ltle doubt that she would feel at home on a Court that is more nservative than ’s been s. Yet she also reprented a major shift. Daniel Bent, a profsor at John Brown Universy, a Christian llege Arkansas, who studi the tersectn of fah and polics, told me that Barrett is “more embedd the nservative Christian legal movement than any Jtice we’ve ever had.” Outsi the Court, Nance emphasized this kship, referrg to Barrett as “Sister Amy, on the si.”</p><p class="paywall">In recent years, nservativ have been tent on stallg judg who will not disappot by beg more centrist over time. Sandra Day O’Connor and Anthony Kennedy sid wh liberal Jtic a few notable s, cludg on that allowed same-sex marriage and upheld Roe. David Souter, who had bee a feral judge jt months before Print Gee H. W. Bh nomated him to the Court, 1990, moved leftward enough that “No More Souters” beme a nservative slogan. A ago, Chief Jtice <a href=">John Roberts</a> mted the unpardonable s of providg a cril vote to keep the Affordable Care Act place. In 2020, the seemgly stalwart Gorsuch livered a blow, wrg <a href=">the majory opn</a> a se which held that civil-rights legislatn protected gay and transgenr workers om discrimatn. On the Senate floor, Josh Hawley, the Missouri Republin who later attempted to discred the rults of the 2020 Printial electn, clared that Gorsuch’s opn marked the end of “the nservative legal project as we know ”—the “origalist” jurispnce, proment sce the neteen-eighti, that claims to be guid by the textual tent of the Foundg Fathers. It was time, Hawley said, for “relig nservativ to take the lead.” Four months later, that new era unofficially began, when Barrett joed the Court.</p><p class="has-dropp has-dropp__lead-standard-headg paywall">For s, leadg members of <a href=">the Feralist Society</a> and other nservative legal associatns have vetted potential appellate judg and Jtic and provid remendatns to Republin Prints. The Feralist Society has tradnally showsed judg wh rerds of high amic distctn, often at éle schools; service Republin Admistratns; origalist loyalti; and a rerd of cisns on the si of regulatn and rporatns. Barrett hadn’t served an Admistratn, and, unlike the other current Jtic, she hadn’t attend an Ivy League law school. She went to Notre Dame, and returned there to teach. The divergenc, though, end up beg pots her favor—pecially at a time when relig activists were playg a more fluential role the nservative legal movement. Notre Dame, which is jt outsi South Bend, Indiana, is a Catholic stutn a eply red state, and ’s one of the relatively few well-rpected law schools where progrsiv do not abound. Barrett’s groundg nservative Catholicism, and even her large fay, began to seem like qualifitns, too. Andrew Lewis, a Universy of Ccnati polil scientist who studi fah-based advocy, told me that relig nservativ often ed to feel “looked down upon by some of the origal Feralist Society members.” But, he went on, “they have creasgly gaed power, and their ncerns have bee more central to the project.”</p><p class="paywall">To some of Barrett’s champns, her life story also offered a retort to the kd of liberal femism they abhorred. When I asked Nance what she most admired about Barrett, she replied, an e-mail, “Amy Coney Barrett is a brilliant, acplished jurist who also happens to be a mother of 7 servg on the hight urt the land. She cimat the argument that women n’t do both, or that women need abortn to ‘live their bt liv.’ ” (Barrett cled my requt for an terview.)</p><p class="paywall">In public appearanc before her nomatn, Barrett was pleasant, non-iologil, and discipled to the pot of blandns. Yet her background and her meanor suggted to social nservativ that, if placed on the Court, she would liver what they wanted, expandg gun rights and relig liberti, and dumpg Roe. In <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">a recent memoir</a>, Tmp’s former chief of staff Mark Meadows, a hard-le nservative, unflattergly scrib Brett Kavangh as “an tablishment-iendly nomee” who had served the Gee W. Bh Whe Hoe. Meadows wr that Tmp, who had almost nomated Barrett 2018, was exasperated by Kavangh’s performance at his nfirmatn heargs—not bee he had to fend off sexual-asslt accatns but bee the sometim tearful nomee had appeared “weak.” Pickg a nventnal Beltway guy had led to disappotment, and “the Print was termed not to make the same mistake twice.” Acrdg to the memoir, Barrett didn’t “miss a beat” durg her first meetg wh Tmp, assurg him that she would follow the Constutn and that she uld handle attacks om liberals. Meadows was stck by “her mment to her fah and to nservative ials.” When she ma a pre-nfirmatn tour of Senate offic, he tsted her to do so whout the aid of a “sherpa”—typilly a former senator who helps break the ice.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-1 viewport-monor-anchor"></div><p class="paywall">In the relig magaze <em>First Thgs</em>, Patrick Deneen, a lleague of Barrett’s at Notre Dame, <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">wrote</a> that she had veloped a eful kd of cultural sulatn, or armor. He extolled her upbrgg Louisiana (“the state wh the hight percentage of native-born rints”) and her immersn the Catholic muny and around South Bend—sometim known, he said, as “Catholic Disneyland.” There, a “mivan full of siblgs” was jt a “regular fay.” Wh Barrett, the natn was gettg “the first jtice to receive her law gree om a Catholic universy,” and someone who had “spent almost her entire life the ‘flyover’ plac of Ameri where ‘gentry liberalism’ is not the domant fashn.” Barrett might “acclimate” to the smopolan secularism of Washgton, D.C., Deneen said, but “there is hope her entire At <a href=">Sonia Sotomayor</a>’s nfirmatn heargs, 2009, Republin senators nounced her for havg argued, a speech, that “a wise Lata” might ufully draw on her life experience— her se, as a Puerto Rin New Yorker— her jurispnce. But many nservativ were eager to spotlight Barrett’s inty, bee suggted an impervns to public-opn polls and the disapproval of astal él. Nance told me that, on a “Women for Amy” b tour that she had anized to generate enthiasm for Barrett’s nfirmatn, “olr women particular would e up to wh tears their ey sayg that they have been wag their whole liv for a nservative woman to be appoted to the urt.” (O’Connor, Ronald Reagan’s appotee, who <a href=">helped fe the promise</a> Casey that prerved abortn rights, apparently didn’t unt.)</p><div><div class="ConsumerMarketgUnThemedWrapper-iUTMTf jssHut nsumer-marketg-un nsumer-marketg-un--article-mid-ntent" role="prentatn" aria-hidn="te"><div class="nsumer-marketg-un__slot nsumer-marketg-un__slot--article-mid-ntent nsumer-marketg-un__slot---ntent"></div><div class="journey-un"></div></div></div><p class="paywall">On the day of oral argument Dobbs v. Jackson Women’s Health, loudspeakers outsi the Court broadst the proceedgs, and some people the crowd surged closer to listen. (Bee of panmic rtrictns, the urtroom was closed to the public.) Breyer, Sotomayor, and <a href=">Elena Kagan</a>, the three liberal Jtic, exprsed ncern that overturng the long-standg precents of Roe and Casey uld severely unrme the prciple of stare cisis—adherence to past lgs on which cizens have e to rely—and make look as though the Court were reversg urse bee there’d been a change personnel. Sotomayor was pecially blunt: “Will this stutn survive the stench that this creat the public perceptn, that the Constutn and s readg are jt polil acts?”</p><div class="Contaer-bkChBi byNLHx"></div><p class="paywall">Veteran observers of the Court often remd the rt of not to leap to nclns on the basis of oral arguments—the Jtic might jt be ttg out ias. But many journalists and legal amics saw this ssn as easier to parse than others. The nservative wg—Roberts, Barrett, Gorsuch, Kavangh, <a href=">Samuel Alo</a>, and <a href=">Clarence Thomas</a>—seemed cled to uphold Mississippi’s ban on virtually all abortns after fifteen weeks of pregnancy, undog Roe’s guarantee of legal abortn up to the pot of fetal viabily. (Doctors currently nsir a fet viable at about twenty-four weeks.) The remag qutn was whether a majory of the nservativ would accept Mississippi’s requt to throw out Roe and Casey altogether. Alo, Thomas, and Gorsuch appeared ready to do so. Kavangh—who had been ls of a sure bet gog —also seemed to be on board, notg that prev Jtic had overturned precents after ncludg that their precsors had been wrong; he voked Plsy v. Fergon and other famo cisns. Roberts seemed to be lookg, as he often do, for a narrower lg—a way to fd the Mississippi law nstutnal whout obleratg Roe.</p><p class="paywall">When was Barrett’s turn, she paid rpect to the “benefs of stare cisis,” but also emphasized that “’s not an exorable mand, and that there are some circumstanc which overlg is possible.” She then proposed that the Court’s opn Casey had relied on “a different nceptn of stare cisis sofar as very explicly took to acunt public reactn.” The implitn was that the Jtic 1992 had been too attuned to momentary polil fluctuatns. She wonred aloud if the Court, gog forward, should “mimize that factor.” As Mary Ziegler, a law profsor at Florida State Universy and an expert on abortn law, told me later, “Barrett didn’t seem as <em>obvly</em> ready to get rid of Roe as some of the others. . . . She has spoken about their dghter Vivian g to South Bend as a malnourished fourteen-month-old, and about their son John Peter arrivg soon after the 2010 earthquake. Yet her remarks about safe havens sound oddly naïve about other people’s experienc of fay, childbearg, and adoptn. She ma no reference to the fact that pregnancy and childbirth pose more health dangers to women than legal abortn do—or that the majory of women who have abortns already have children at home, which means that safeguardg the health of those women protects their livg children. Barrett also appeared to assume that people who relquish their fants will no longer be implited any sort of relatnship wh them.</p><p class="paywall">Marley Greer, a -founr of the advocy anizatn Bastard Natn, told me that many advot for adopte are skeptil of safe-haven laws, bee they n make much harr for potential adopte to obta birth certifit and health rmatn nnected to their fay history, or to ntact their blogil parents the future. Moreover, when an fant is dropped off anonymoly, ’s extremely difficult to tell if someone has been erced to dog so. The brief filed by Mississippi 2021 mak only a passg mentn of them, and dozens of amic briefs filed on behalf of Mississippi don’t ce them at all. But two briefs filed by relatively obscure anizatns offer sunny asssments of safe havens as an antidote to abortn. <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">A brief</a> om the Jtice Foundatn, a Texas-based ligatn firm that handl anti-abortn s, ntends that “as a matter of law, there are no more ‘unwanted’ children Ameri bee of the major change circumstanc known as Safe Haven laws,” addg, “Even if stat ban or rtrict abortns pletely, or if only one clic exists a state, no woman would have to re for a baby if she do not have the sire or abily to do so.” Reason for Life, a Christian mistry Palmdale, California, filed <a href=">a brief</a> argug that the safe-haven approach “giv lovg upl a chance to realize their long-awaed dream of welg a baby to their hearts and hom,” while also providg “mothers a way to put childrearg rponsibili behd them almost stantaneoly.” The Reason for Life brief is creded, part, to three lawyers at Boyn Gray & Associat, a boutique firm Washgton, D.C.; one of them, Michael Bchbacher, was a law stunt of Barrett’s at Notre Dame.</p><p class="paywall">Many Court observers found Barrett’s foc on safe havens perplexg. But, when I asked Nance what she had appreciated about Barrett’s performance on the Court th far, she highlighted that moment. Barrett “astutely brought up the topic of adoptn the abortn ntext at oral arguments,” she said. “We wele the broang of the issu the abortn nversatn.”</p><p class="paywall">Barrett’s personal views on abortn are no mystery. In 2006, she signed her name to a two-page ad, placed the South Bend <em>Tribune</em> by the group St. Joseph County Right to Life, that fend “the right to life om fertilizatn to natural ath” and clared that was “time to put an end to the barbaric legacy of Roe v. Wa and rtore laws that protect the liv of unborn children.” In 2015, she signed an open letter to Catholic bishops affirmg the Church’s tradnal teachgs on genr rol, divorce, and the sancty of life. A te origalist, is said, sometim arriv at a ncln whose rults she personally don’t like. Slia was a bltery, patrtic tradnalist who openly disdaed what he lled “sandal-wearg, beard weirdos who go around burng flags.” Yet 1989 he sid wh the majory a 5–4 cisn holdg that the First Amendment protected the right to burn a flag prott. “That was very paful for Jtice Slia,” Barrett said, a talk five years ago. In a 2019 lecture, she noted that, as a judge on the Seventh Circu, her origalist approach had led her to dissent a Send Amendment se which the other judg had nclud that nonvlent felons uld be nied the right to own a gun. Perhaps bee nservativ are generally not very rights-oriented when to felons, she argued that her posn might seem “radil” to some. (To others, her dissent might seem keepg wh a rigid nservative allegiance to gun rights.)</p><p class="paywall">An origalist readg is still an act of terpretatn, not a chemil tt which a jurist appli a formula and the answer pops up. Legal methodology and polil iology are not easy to disentangle—they often e a package. Most origalists are nservativ, and most nservative jurists and legal scholars are origalists. It’s hard to accept that a judge who views abortn as the slghter of nocents (or who nsirs a lchp of women’s eedom) n easily banish such a nvictn. It’s ls a matter of bad fah than of a lim on the human pacy to partmentalize re valu. In any se, sce origalists mata that a right to abortn n’t be ferred om the Constutn, the goals of an origalist and an opponent of legal abortn often dovetail nveniently. But, so far, Roe has survived the origalist era. Lately, some right-wg Republins have, like Josh Hawley, been makg known that they don’t see much e for the origalists on the Court if they don’t liver Roe a fatal blow. Rachel Bovard, a lumnist for the Web se the Feralist, recently <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">wrote</a>, “If the oute of Dobbs is ed a hedge that spls the Court’s nservativ—or, to put more bluntly, if the nservative legal movement has failed to produce Supreme Court Jtic who are fortable overturng two outrageoly nstutnally fective lgs on abortn—we will be left to jtifiably wonr what the whole project has been for.” Kelly Shackelford, the head of First Liberty Instute, an anizatn that advot for relig eedom, said that, among his hort, there was a sense that “if the origalists n’t get right wh the abortn s, what’s the e of a nservative legal movement that follows origalism?” Shackelford thks that ’s too early for this kd of impatience—and he’s optimistic about Barrett’s role on the Court—but he acknowledged that such talk “has been heavily focsed” on what she will do the Mississippi se.</p><p class="paywall">Dobbs v. Jackson Women’s Health probably wouldn’t have ma to the Court s prent form if Barrett hadn’t been there. When Mississippi first <a href=">petned the Court</a>, June, 2020, noted that “the qutns prented this petn do not require the Court to overturn Roe or Casey.” But, as Ruth Marc <a href=">poted out</a> the Washgton <em>Post</em>, “wh the se accepted for review, Gsburg ad and Barrett her seat, Mississippi cid to go for broke.” The platiffs now asserted baldly that “overlg Roe and Casey mak rolutn of this se straightforward,” and ntend that “nothg nstutnal text, stcture, history, or tradn supports a right to abortn.” Barrett may not yet be willg to provi what would most likely be the fifth vote—alongsi Kavangh, Alo, Thomas, and Gorsuch—to undo the Court’s abortn precents. In the end, no matter what she cis, David Fontana, the Gee Washgton Universy profsor, told me, “she’s the center of the story—eher she’s the woman who voted to overturn Roe v. Wa, or she don’t, and then one round of stori is ‘Man, the nservativ n never w. They handpicked her for this and still uldn’t get done.’ ”</p><p class="paywall">If Barrett cl to overturn Roe the Mississippi se, uld give momentum to nservative scholars and punds who have already exprsed disappotment origalism. This factn would like to replace wh “mon-good nstutnalism” or “mon-good origalism”—approach that make no apologi for elevatg their versns of moraly over others’. In <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">a recent manifto</a>, the legal mentators Hadley Ark, Garrett Sneker, and Matthew Peterson, along wh the opn edor of <em>Newsweek</em>, Josh Hammer, argued for a “more robt jurispnce rooted the prcipl and practic of Amerin nstutnalism before the last century of liberalism began s attempt to remake Ameri.” Judg, they wrote, had to stand agast a “moral relativism brookg no lims, not even those objective tths nature that distguish men om women.” For a time, origalists had held out agast “the rapid hegemonic rise and the sweepg reach of ‘Progrs’ ”—the manifto praised District of Columbia v. Heller, which Slia terpreted the Send Amendment as a guarantee of an dividual’s right to bear arms, and Cizens Uned, which equated unlimed rporate mpaign spendg wh ee speech. Subjects will e to thank the ler whose legal strictur, possibly experienced at first as ercive, enurage subjects to form more thentic sir for the dividual and mon goods, better habs, and beliefs that better track and promote munal well-beg.</p></div></blockquote><p class="paywall">That “possibly experienced at first as ercive” is a typil Vermle flourish—an airy dismissal of fears that his preferred regime would be dystopian for cizens of a pluralistic society who share neher his moral viewpot nor his orientatn toward thory.</p><p class="paywall">As a self-profsed origalist, Barrett nnot be tegorized as a disciple of this movement. Although Vermle has exprsed admiratn for her, I uldn’t fd a reciprol tribute. Yet she is close enough to this school of thought to feel prsure om . She has lectured at the Blackstone Legal Fellowship, a trag program for Christian law stunts n by Alliance Defendg Freedom, which regularly reprents platiffs who claim that their relig liberti have been vlated by antidiscrimatn laws protectg L.G.B.T.Q. people. Amanda Hollis-Bsky, a polil scientist at Pomona College who has wrten two books on the nservative legal movement, told me that the views unrpng mon-good nstutnalism are “que proment” at Blackstone, addg, “The tensns between natural-law origalists and libertarian origalists are already prent the Feralist Society, and Barrett ss at the crossroads of both of the factns.” Moreover, as a nservative Catholic, Barrett has been steeped natural-law teachgs—among them, that ntraceptn and same-sex relatns are unnatural and therefore immoral.</p><p class="paywall">Ilya Shapiro, a former legal analyst at the Cato Instute, a libertarian thk tank, told me that he is skeptil of the “old nventnal wisdom” that if the Court overturned Roe there would be “this apolyptic huge popular reactn agast , and would throw our polil world to turmoil and affect the next electns.” Republin legislators and ernors have already been sharply rtrictg abortn, whout currg polil damage. In any se, Shapiro thks that, to the extent that Barrett and other Tmp-appoted Jtic are worryg about polil fallout, this is not the fallout they are worryg about. Gorsuch, Kavangh, and Barrett, havg been “reared the morn nservative legal movement,” are likely more attuned to ncerns that they will unrme that movement by upholdg Roe. As Shapiro observed, they’re all associated wh the Feralist Society—“they re about rigoro methods of terpretatn that uld get blown up . . . a world where origalism is discreded and mon-good nstutnalism is the most attractive mo of thkg.” (Last month, Shapiro apologized after tweetg, reference to Print Bin’s pledge to nomate a Black woman to replace Breyer on the Court, that Bin should nomate the appellate-urt judge Sri Srivasan stead of a “lser black woman.”)</p><p class="has-dropp has-dropp__lead-standard-headg paywall">At Barrett’s appellate-urt nfirmatn hearg, 2017, Senator Feste voiced an anxiety that Barrett’s relig beliefs might pose nflicts wh her judicial role. It was a legimate pot, but Feste ed an odd, unfortunate phrase—“The dogma liv loudly wh you.” Conservativ amed the ment as élist fah-bashg. It beme a meme, and was prted on mugs and T-shirts. Many of Barrett’s admirers embraced the phrase, bee to them seemed thrillgly appose.</p><p class="paywall">Amy Coney was born 1972 and grew up Metairie, a mostly whe, Republin-leang suburb of New Orleans. Her father, Mike, was a lawyer for Shell Oil; her mother, Lda, was a high-school French teacher turned homemaker. They had seven children—six girls and a boy—and Amy was the olst. The Coneys were Catholic but belonged to a group lled People of Praise, a close-kn fah muny wh a charismatic flavor that would have been more faiar to born-aga Christians than to most cradle Catholics. In 2018, Mike Coney wrote <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">an say</a> for his church’s Web se explag that People of Praise is a venant muny, meang that members “promise to share life together and to look out for each other all thgs material and spirual.” In South Bend, some of Barrett’s children attend the Try School, which was tablished by members of People of Praise; for nearly three years, she sat on the board of Try, which also has mp Falls Church, Virgia, and Eagan, Mnota. (People of Praise was found 1971, and is fluential South Bend; natnwi, the group has only about fifteen hundred adult members.) When Barrett’s Court nomatn was announced, some progrsiv went a ltle crazy about People of Praise, unfairly llg a sexist cult. But the group do hold some tradnal ias about genr rol and sexualy. “Men and women separately meet weekly small fah groups,” Mike Coney wrote his say. The group’s teachgs strs the God-given plementary of mal and femal. In a 2019 appearance, she relled dog so well school that when she got “an A-m French” she was “pretty upset.” Rhos has an honor that is enforced entirely by stunts. Barrett served on the Honor Council, whose members have the power to spend or expel their peers for cheatg, lyg, or stealg. In 1994, Barrett spoke to a mp magaze about the “heavy rponsibily” that me wh beg a uncil member: “You have the power to affect someone’s life. Wilson wre that Notre Dame is “arguably the natn’s ele <em>nservative</em> law school.” An unnamed Notre Dame faculty member told them, “It’s kd of like the Feralist Society distilled, the sense of that’s the place you go for your judg, and this is where you go for your clerks.” Sce the neteen-eighti, the nservative Christian legal movement has been creatg s own law schools—Ave Maria, Florida; Regent, Virgia—but none n claim the history or the prtige of Notre Dame. And though there are other well-regard law schools where nservativ n fd a cril mass of like-md lleagu—the Universy of Chigo, for stance—those stutns are better known for law-and-enomics or libertarian orientatns than for relig on.</p><p class="paywall">Before the eighti, nservative Catholics and whe evangelil Prottants seldom allied, or even mixed, but members of the fahs creasgly share polil and social perspectiv, and are pecially aligned on such issu as abortn and gay rights. David Campbell, a polil-science profsor at Notre Dame who studi relign and polics, told me that this is one reason “Amy Coney Barrett received such full-throated support om evangelil Christians who, thirty or forty years ago, would not have nsired her qualified—those distctns have fad away.”</p><p class="paywall">At Notre Dame, Campbell told me, “the law school is wily nsired to be the most nservative llege.” Barrett was the executive edor of the law review, got stellar gras, embraced origalism, and ught the notice of profsors wh nnectns to the Feralist Society and the Republin Party. She also met Jse, who had grown up South Bend and attend Notre Dame as an unrgraduate, and was two years behd her at the law school. When she graduated, she clerked for Lrence Silberman, an appellate judge on the D.C. Circu who’d been appoted by Reagan, and then for the biggt, badst origalist of them all, Slia. The Jtice was known for provokg his clerks to argue back—he liked “gog toe-to-toe,” as Barrett has relled. The term she clerked for Slia, 1998-99, was a quiet one. As Jay Wexler, who clerked for Gsburg that year, put to me, there was no pecially ght se that “ma anybody want to ph anybody to a founta.” He add, “It was the kd of year where liberal and nservative clerks were iends.” Barrett was hardworkg and well liked. Wexler, who is now a law profsor at Boston Universy, nicknamed her the Conenator—bee she was a powerhoe but also bee seemed funny, given her gracns.</p><p class="paywall">In 2017, all of Barrett’s fellow-clerks who were still alive—thirty-four people—signed <a data-offer-url=" class="external-lk" data-event-click="{"element":"ExternalLk","outgogURL":"" href=" rel="nofollow noopener" target="_blank">a letter</a> supportg Tmp’s nomatn of her to the Seventh Circu Court of Appeals, praisg “her nscient work ethic, her rpect for the law, and her remarkable legal abili.” (Some among this iologilly diverse group felt que differently when Barrett was nomated to replace the liberal in Gsburg.) Nile Gart, who clerked for Jtice Thomas, beme a close iend of Barrett’s, and rells that, among the female clerks, there were “four of who hung out a lot—polilly, we were not the same, but we were two Catholics, a Mormon, and an Orthodox Jew, all relig.”</p><p class="paywall">In 1999, Barrett got married. After her Court clerkship, she worked for two years at a D.C. law firm, and then beme a John M. Ol Fellow at the Gee Washgton Universy. Ol Fellowships were a llaborative project between the Feralist Society and the Ol Foundatn, and were signed to enurage more nservativ to enter the legal amy and to prepare them for succs. Nile Gart, who also beme a law profsor at Notre Dame, sent me an e-mail after we talked, sayg she wanted rears to know that, as talented as Barrett is, “she never nsired (or sired) beg a judge, let alone a Jtice.” Gart ntued, “She refully nsired opportuni as they arose, but never angled for them. She and Jse were ntent here South Bend, she loved her job and her life . . . and, fact, this was a sacrifice for them both. Ambn played no role her nomatn or acceptance of . She’s not a polil actor.” Barrett’s iend Aimee Buccellato, who ns an archecture firm South Bend, sound a siar note when she talked about the “sacrifice” that Amy and Jse had ma uprootg their fay. The Barretts, who moved to the D.C. area 2021, had prayed on the cisn. But downplayg her ambn—and, let’s face , she’s gotten pretty far life—also feeds a certa wishful narrative. It mak Barrett sound pure enough to whstand the swampy atmosphere of Washgton and the reerist temptatns of éle approval. Soon after she was nomated, the Herage Foundatn held an onle event which a panel of speakers discsed Barrett. One of the speakers, John Baker, a Louisiana State Universy law profsor emer, had known her for many years. The morator asked if Barrett would bee another centrist disappotment, like Souter or Kennedy or Roberts. Baker replied that was a matter of character. What down to, he said of the Jtic, is: “Are they willg to be vilified?” Alo was. Thomas was. Slia had been. “Others, when they get vilified, tend to go squishy,” Baker said. “You’ve got to put people up there for whom their ambn has not been to get on the Supreme Court. And I n tell you that has not been Judge Barrett’s ambn. At her Supreme Court nfirmatn heargs, she had been asked if she posed a threat to Obamare— 2017, she had published a book review which she briefly but sharply cricized Roberts’s reasong for savg , wrg that his terpretatn of the Affordable Care Act had gone beyond the statute’s “plsible meang.” But upon beg a Jtice she helped the A.C.A. survive another challenge, signg on to what the <em>Tim</em> <a href=">lled</a> “Breyer’s most and technil majory opn” upholdg . Soon after her nfirmatn, she joed Gorsuch, Alo, Thomas, and Kavangh supportg the Roman Catholic Dce of Brooklyn’s challenge to lims set by New York State on the number of relig ngregants who uld gather for servic. On January 13th, she voted wh the nservative bloc to reject the Bin Admistratn’s mandate for large employers to require their workers to be vaccated or to be tted regularly. The liberals sound eply trated. “This is a panmic which nearly a ln people have died,” Kagan said. “It is by far the greatt public danger that this untry has faced the last century. . . . And this is the policy that is most geared to stoppg all this.”</p><p class="paywall">In a Send Amendment se that the Court heard this past fall, which challeng a New York law requirg people to provi a particular reason for needg to rry a ncealed handgun public, Barrett has, as the Mississippi abortn se, already exerted fluence jt by her prence. Adam Wkler, of U.C.L.A., said, “The Court has had ncealed-rry s prented to for more than ten years, and had shied away om virtually all of them until Barrett was nfirmed.” It tak only four Jtic’ vot to accept a se, a procre known as grantg certrari, or cert. Prumably, once Kavangh joed the Court there would have been enough, but, Wkler noted, “ seems likely that Barrett’s vote mattered not so much to obta the four vot for cert but to nvce Alo, Thomas, Gorsuch, and Kavangh that they had a five-Jtice majory” for the ultimate lg. And Barrett, given her dissent as an appellate judge Kanter, “is likely to be a very strong nservative vote agast gun ntrol.”</p><p class="paywall">In oral arguments, Barrett has been an outspoken participant, terptg unsel when she wants a qutn answered more clearly or quickly, but she is neher a showboat nor a w. Her iend and Notre Dame Law School lleague Richard Gart said, “She’s not playg for lghs or engagg rhetoric for show. She’s reful, discipled, focsed.” A former legal lleague of Barrett’s who didn’t want to be named, bee he sometim argu before the Court, said of her, “She knows the s at a high level of tail. She don’t ask nonsense qutns or play gam. And she wants to hear your answer. That don’t necsarily mean that there is an answer that uld take her ial tun and turn around. But she do really want to know that she has heard the bt versn of what you thk.”</p><p class="paywall">Barrett thored jt four majory opns her first term, s that didn’t attract much attentn. Her wrg is not flashy. The former lleague said, “People like to talk about how the prose of Gorsuch or Kagan sparkl. I don’t thk she is <em>aimg</em> for sparkle. She valu anizatnal and explanatory clary.”</p><p class="has-dropp has-dropp__lead-standard-headg paywall">In a relign se which Barrett wrote a ncurrence, was possible to fer that she is cled to move more slowly and ggerly than some of her nservative lleagu. But you uld also see how much more receptive the Court has bee to relig claims, and how Barrett solidifi that shift. The Jtic were weighg whether the Cy of Philalphia uld ny ntracts to a Catholic social-servic agency that would not place foster children wh same-sex upl. In a narrow, unanimo cisn, the Court said that, for technil reasons, Philalphia uld not refe to work wh the Catholic agency—th dodgg the bigger qutn of what to do when gay rights and relig rights clash. Alo was censed by this utn. He’d seen the se as an opportuny for the Court to toss out a 1990 lg that he and many nservativ loathe, Employment Divisn v. Smh, which had held that a ntral, generally applible law don’t vlate the ee exercise of relign. In <a href=">a blisterg seventy-seven-page ncurrence</a> the Philalphia se, Alo plaed that the Court had “emted a wisp of a cisn that leav relig liberty a nfed and vulnerable state.”</p><p class="paywall">Barrett wrote a short, gent ncurrence which she said that although she also found Smh problematic, she wasn’t ready to disrd . She listed qutns that would need to be answered first, and said that she was “skeptil about swappg Smh’s tegoril antidiscrimatn approach for an equally tegoril strict scty regime, particularly when this Court’s rolutn of nflicts between generally applible laws and other First Amendment rights—like speech and assembly—has been much more nuanced.” The <em>Wall Street Journal</em> edorial page, among other nservative mentators, was dismayed by Barrett’s own nuanc. Smh had centered on two Oregon men who had been fired om their jobs for g peyote, an illegal substance, Native Amerin relig ruals. The Jtic had held that the state hadn’t discrimated agast them on relig grounds when nied them unemployment benefs, bee a state law forbiddg the e of peyote applied to every rint equally.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-7 viewport-monor-anchor"></div><p class="paywall">Nelson Tebbe, a nstutnal-law profsor at Cornell, told me that most relig-eedom ligatn is now “beg brought by the largt relig groups, cludg Prottant evangelils and Catholics.” Tebbe explaed that the ligants would likely say that such lawsus have bee necsary “bee the ernment has bee more progrsive, and more willg to regulate long-cherished beliefs and practic.” Var Christian groups have amed the regnn of same-sex marriage, civil-rights protectns for L.G.B.T.Q. people, and the guarante of ntraceptn verage unr the A.C.A. as vlatns of other Amerins’ right to exercise their relign.</p><p class="paywall">It’s an argument that assertively expands the spe of the ee-exercise clse to ver not jt worship, proselytizg, and relig tn but, creasgly, activi the public square that impge directly on other people—such as refg to get vaccated or to provi weddg goods for a same-sex uple. Robert Tuttle, a law profsor at the Gee Washgton Universy who wr extensively about the relign cls, scribed this phenomenon as tryg to “sure that the fahful n exempt themselv om norms that legal or majorarian procs have changed.” He went on, “The battle is to get ntrol of stutns, reverse the norms, and restate a moral orr patible wh their fah.”</p><p class="paywall">Lee Epste and Eric Posner, their article on the Supreme Court’s relign jurispnce, found that lgs favor of relign have creased om about forty-six per cent unr Chief Jtice Earl Warren (whose tenure ran om 1953 to 1969) to eighty-three per cent today, wh the biggt leap occurrg unr Roberts. “The Warren Court relign s were notable for protectg mory or non-mastream religns,” Epste and Posner wre, bee at the time mastream Christian groups weren’t claimg a beleaguered stat. When non-mastream platiffs have e before the Roberts Court, they have also fared well, lendg some crence to what Alo and other nservativ sist—that they re about relig liberty wr large, not jt for Christians. The sole exceptn that Epste and Posner found, however, is a tellg one: when Hawaii challenged Tmp’s 2017 travel ban unr the tablishment clse of the First Amendment, sayg that discrimated agast Mlims, the Supreme Court upheld the ban.</p><p class="paywall">In December, the Court heard another important church-state se. The State of Mae pays private-school tun for fai livg ral areas that lack a public sendary school, but historilly has exclud relig schools om the arrangement. Three upl sued Mae, sayg that their First Amendment rights had been vlated by the state’s refal to subsidize their children’s tn at relig schools. Most scholars and journalists followg the se thk that the Jtic will le for the fai, wh implitns for other s centered on church-state separatn. Mih Schwartzman, the profsor, said, “This se is gog to tell a lot about how far the Court will go allowg the fundg of private relig schools. This Court, more than any Amerin history, is prepared to give relign privileged treatment—to <em>prefer</em> over nonrelig views.”</p><p class="paywall">Durg the oral argument, Barrett qutned the lawyer argug for the State of Mae about why children attendg relig schools uld not receive tun om the state, too. “All schools, makg choic about curriculum and the formatn of children, have to e om some belief system,” she said. In prev eras, though, the Court was que clear that, no, that’s not the se—’s jt enforcg a separatn between church and state.” Barrett’s ia, which the Court seemed ready to embrace, was that tn was evably a value-based enterprise, and that relign was jt one perspective among many.</p><p class="has-dropp has-dropp__lead-standard-headg paywall">Though nservative Jtic now domate the Court, is strikg how firmly they hold to the notn of themselv as persecuted figur a hostile Ameri. Alo, one of the most powerful people the untry, seems chronilly put out. In 2020, after a long strg of Court victori for relig-eedom lawsus, he gave a speech to the Feralist Society which he warned that “ certa quarters, relig liberty is fast beg a disfavored right.” He also asserted that “the right to keep and bear arms” was “the ultimate send-tier nstutnal right.” The Ameri of 2022 is que plaly not a untry where cizens’ abily to worship eely is jeopardy. Nor is the natn on the cp of ncellg gun rights. Yet the nservative Jtic often act as if they were alone a broken elevator, jabbg the emergency button and hollerg for help.</p><p class="paywall">The realy is that Amerins face a future which the Court, much like the rt of the untry’s polil astcture, will be imposg an array of nservative, mory views, some of them religly based. A majory of Amerins want to keep abortn legal, but the Jtic may well overturn Roe anyway. Some stat will act to prerve abortn rights, and Amerins wh rourc will travel to those stat or procure abortn pills onle; revokg the legal right won’t stop people om termatg pregnanci. The burn will fall disproportnately on poor women and women of lor. In the g months and years, the Jtic will be weighg s on affirmative actn, gun rights, votg rtrictns, immigratn, environmental regulatn, and the separatn of church and state. Their lgs on many of the issu won’t be that hard to gus, however often they sist that they are guid merely by their close and unpredictable readgs of foundatnal texts.</p><p class="paywall">In September, ls than two weeks after the Court cled to block a dranian anti-abortn law Texas that employed a nstutnally spect mo of cizen enforcement, Barrett gave a speech at a private event Louisville, Kentucky. “My goal today is to nvce you that this Court is not prised of a bunch of partisan hacks,” she reportedly said. “The media, along wh hot tak on Twter, report the rults and the cisns. That mak the cisns seem rults-oriented.” Other Jtic appear siarly ncerned about prervg the Court’s stutnal legimacy. Public-approval ratgs of the Supreme Court are at an all-time low, and there’s been ser talk Washgton of reformg by expandg s numbers or limg Jtic’ terms. Not long before Stephen Breyer announced his retirement, he published a book which he assur rears that he and his lleagu “studly” set asi iology when cidg a se. Perhaps, though, the avowals are partly why Amerins tst the Court ls; they n feel an awful lot like gaslightg.</p><div data-attr-viewport-monor="le-recirc" class="le-recirc-wrapper le-recirc-observer-target-8 viewport-monor-anchor"></div><p class="paywall">David Fontana, the Gee Washgton Universy profsor, said that the g battl over Breyer’s succsor may further ero the Court’s image as a bastn: “It will mean that there will be very polil nfirmatn heargs around the time the Court is nsirg and then issug ntroversial cisns on issu like whether to overle Roe. The athetics will be ugly.”</p><p class="paywall">Unsurprisgly, Barrett’s Louisville speech was not a stem-wr, like Alo’s. But the difference was more than a matter of tone. Whereas Alo’s eptn of anger seemed forthright, Barrett’s p sistence that she had no agenda did not. Ined, the fom she had chosen for her speech was hardly ntral. She had gone to Kentucky to help celebrate the thirtieth anniversary of the McConnell Center—a learship-trag center, at the Universy of Louisville, named for Mch McConnell, who had helped secure her nfirmatn time to rally Republin voters before the 2020 electn. McConnell had been brazenly hypocril his fealty to Tmp and the Republin Party: he had blocked Barack Obama’s nomatn of <a href=">Merrick Garland</a> to the Court for eight months before the 2016 Printial electn, sayg that voters should be allowed to ci who the next Jtice would be. In Louisville, McConnell praised Barrett as a product of “Middle Ameri” who didn’t try to “legislate om the bench.” The Jtic aren’t partisan hacks, but that don’t mean they aren’t polil. Barrett may be pursug her goals more slowly, and more utly, than Alo. But what’s the hurry?
