" As to the claim of appurtenant water rights, Gay & Robson had the burn of proof, but no evince was troduced by Gay & Robson to meet this burn. Regnizg that prcriptn uld not n agast the ernment, the trial urt held that McBry's prcriptive right to water should be ducted om or charged agast the water rights of Gay & Robson.

We believe this was error if McBry had been prcribg large amounts of water, the trial urt should have orred McBry to cease prcribg the State's portn, not impose a double burn on Gay & Robson by havg the amount of water ed by McBry charged agast Gay & Robson.

Also, Gay & Robson may not claim the right to appropriate water adverse to the State's riparian and appurtenant rights bee one may not claim tert or tle to State property, or right or tert by adverse e.

As between the State and McBry, and McBry and Gay & Robson, the State is the owner of the water flowg the Koula Stream and Hanapepe River. The State, McBry and Gay & Robson have both appurtenant and riparian rights to water nnectn wh land wh the Hanapepe Valley. Neher McBry nor Gay & Robson has any right to divert water om the Koula Stream and Hanapepe River out of the Hanapepe Valley to other watersheds.
